January 22, 1991 in respect 0r the grievances of T.
Greer at al and an Order referring the matter back to
the Grievance S8ttl8E8nt Board t0 a Board diff8r8ntly
constituted:
(b) the Applicant'o cost Or this application:
(c) such further and other Order as to this Xonourable
Court may seem just.
2. The grounds for th~~application are:
(a) The Respondent the Ontario Crown Employees Grievance
Settlement Board ("the tiard') made an error oi law
$oing to its jurisdiction and d&lined its jurisdiction
in determining ,that seasonal onployaes of the Crowm
cannot rile classirication grievances, d8Spite th8 fact
that there is no 8Xpre55 statutory or contractual
pkohibition on such filing:
(b) The ioard erred in a manner going to jurisdiction and
declined its jurisdiction by finding that it had no
jurisdiction to direct: the Respondent emplOyOr to
create a ClaSSifiCatiOn to' be used a5 an equivalent
