AWARD
Hearings were held in respect of this grievance on
November 6, 1987; September 23, 1988; and on June 30, 1989. On
the last of these dates, the Boa~rd was advised that the parties
had reached agreement on the issues in dispute on a without
precedent or prejudice basis. Pursuant to the request of counsel
to incorporate the terms of the Memorandum of Settlement in an
award, the Board orders as follows:

The Ministry agrees that Article 4 of the Collective
Agreement was breached in the conduct of competition
RE: 053/86 (Library Clerk - Library Technician 2).
The Ministry agrees that the grievor shall be granted
the position of Library Technician-Library Technician 2
effective July 24, 1989.
The parties recognize that no retroactive pay shall be
payable to the grievor as a consequenc~e of paragraph 2 of
this memorandum. The Ministry agrees that the grievor
shall receive the maximum salary of the Library
Technician 2 classification on her appointment to the
position of Library Technician.
The Ministry agrees that the’grievor’s work assignments
shall~ include primary responsibility for the reception
duties of the position of Library Technician pending
the appointment of additional-classified staff to that
position. Upon the appointment of additional staff,
reception duties will be shared equa.lly among classified
staff.
The grievor and O.P.S.E.U. agree to immediately withdraw
the above-captioned grievance.

6. This memorandum shall not be placed before the Grievance
Settlement Board in pursuit of any other grievance.
