DECISION_
This union grievance was scheduled to be heard on
July 15, 1988, before this Board. At the commencement
of the hearing the parties indicated their desire to
engage in discussions aimed at resolving their dispute.
The Board consented and recessed.
Subsequently when the panel reconvened, the parties
advised the Board that they were successful in resolving
their dispute. The following Memorandum of Settlement
was filed with the Board with a request that it be
incorporated in a formal decision of the Board.

BETWEEN:
Ontario Public Service Employees
Union
(hereinafter called the "Union")
and
Management Board of Cabinet
(hereinafter calied the "Employer",
The parties agree to the settlement of union
grievance 2570/87, on the following terms:

1. The parties recognize that the collective agreement
contains rights and obligations governing Worker's
Compensation.
2. The employer agrees that effective September i,
1988 no Ministry shall offer and no employee under
an award shall use the short term sickness plan as
an option following the expiry of the application
of Article 54.2 of the collective agreement.
3. The employer will issue appropriate directives to
all ministries setting out the provisions of
paragraph 2 above..
4. The settlement shall have no application LO
empioyees who are currently using tne short term
sickness plan in lieu of the provisions of Article
54.3 of the collective agreement.
5. The grievance is hereby withdrawn.
6. This memorandum of settlement is entered into
without admission of liability by either party and
solely in order to resolve the grievances amicably.

The parties further requested that the individual
grievances in files 2373/87 and 2374/8l;which were
scheduled to be heard before this same panel after the
hearing of the Union grievance in file 2510/87 be
adjourned sine die. The Board hereby consents to that
request.
In accordance with the minu,tes set out above, this
grievance is hereby withdrawn.
