INTERIM ORDER
A teleconference was held with Counsel to deal with issues of pre-hearing disclosure.
After hearing the submissions of Counsel, I ordered that the Employer provide to Union
Counsel forthwith the following:
(i) all interview notes and statements of bargaining unit witnesses relevant to
these proceedings; and
(ii) a copy of Dr. Dimock's letter to the Employer or Employer Counsel
pertaining to the Grievor.
Employer Counsel also undertook to provide to Union Counsel a general outline of the types of
misconduct relied upon by the Employer to support its decision to terminate the Grievor's employment.
In addition, Employer Counsel undertook to advise Union Counsel of the witnesses he intends
to call on the first day of hearing, and will do so as soon as possible, making his best efforts to do so at
least one week prior to the commencement of the hearing.
I remain seised with this matter.
DATED AT TORONTO, ONTARIO this 31st day of January, 2000.
Mary Lou Tims - Vice-Chair
