Re: The Crown in Right of Ontario as represented by the Ministry of Health and Long-Term
Care
Re: Grievance concerning the Ministry of Health and Long-Term Care and the following
Divisions of the Ministry:
- Acute Services and Community Health Divisions
- Corporate and Direct Services Division
- Health System Accountability and Performance Division
Whereas AMAPCEO and the Ministry entered into three separate Minutes of Settlement on
April 5, 2007 and May 17, 2007, copies of which are attached to this Order,
And whereas the Ministry has failed to comply with some of the requirements of each of the
Minutes of Settlement
And whereas the Ministry has consented to the terms of the following order,
The Grievance Settlement Board therefore orders the Ministry as follows:
Corporate and Direct Services
1. The positions listed in paragraph 1 of the settlement dated May 17, 2007 will be filled not
later than February 28, 2008. AMAPCEO will be provided with a copy of the postings
and a letter advising it of the name and position number(if there is a position number) of
the successful applicants not later than February 28, 2008, together with job
specifications for the positions.
2. The non public servants referred to in paragraph 2 of the settlement dated May 17, 2007
will be terminated not later than December 31, 2007, and AMAPCEO will be provided
with a copy of the letters to the non public servants advising them of their termination,
not later than December 31, 2007. E. Wong may be retained as an unclassified employee
for a maximum of six months in order to provide knowledge transfer.
Acute Services and Community Health Divisions
3. The positions listed in paragraph 1 of the settlement dated May 17, 2007 will be filled not
later than January 31, 2008. AMAPCEO will be provided with a copy of the postings and
a letter advising it of the name and position number(if there is a position number) of the
successful applicants not later than January 31, 2008, together with job specifications for
the positions.
4. The non public servants referred to in paragraph 2 of the settlement dated May 17, 2007
will be terminated not later than January 31, 2008, and AMAPCEO will be provided with

a copy of the letters to all the non public servants advising them of their termination, not
later than January 31, 2008.
5. Some of the non public servants listed in paragraph 3 of the Minutes of Settlement have
been terminated. All others will be terminated not later than December 31, 2007 and, not
later than December 31, 2007, AMAPCEO will be provided with a copy of the letters to
all the non public servants advising them of their termination. However, if the person was
terminated prior to the date hereof, then the Director of the Division (or, if the Director is
no longer employed by MOHLTC, the Director of Human Resources) shall certify to
AMAPCEO not later than December 31, 2007 the last date on which the person
performed services. AMAPCEO may then pursue payments with respect to any such
persons not terminated until after June 30, 2007, save and except for numbers
70,73,82,87 and 89 who will be terminated not later than December 31, 2007, and the
payment issues in respect of those persons is included in paragraph 7.
Health System Accountability and Performance Division
6. The positions listed in paragraph 1 of the settlement dated May 17, 2007 will be filled
not later than February 28, 2008. AMAPCEO will be provided with a copy of the
postings and a letter advising it of the name and position number of the successful
applicants (if there is a position number) not later than February 28, 2008, together with
job specifications for the positions.
General Provisions
7. In consequence of the Ministry's failure to comply with the three settlements above,
AMAPCEO shall be paid forthwith and not later than December 31, 2007 the sum of
Twenty-Three - Thousand-Nine Hundred—Thirteen dollars ($23,913.00.)
8. Provided that the Ministry complies with this settlement, this order resolves all issues in
connection with the above listed Minutes of Settlement, save and except for paragraph 5
where AMAPCEO may pursue payment after receiving the notices of termination.
9. Arbitrator Brown remains seized to deal with all issues arising from an allegation of
failure by the Ministry to comply with the terms of this Order.

Whereas AMAPCEO filed a dispute under the collective a ement between the
Employer and AMAPCEO;
And whereas the Employer provided a list of-poss (numbers 90-166
inclusive) concerning the Ministry of Health and Long-Term Care, Health System
Accountability and Performance Division (attached as Appendix"A"to the
Employees disclosure
), pursuant to the disclosure Order dated January 16, 2407;

The parties have agreed as follows:
1. The Employer will create 10 (ten) full-time classified AMAPCEO bargaining
unit positions, consistent with the following positions:

final settlement of the BUI issues in respect to paragraphs 1 and 4, no later I

discussions between the parties, and scheduled for mediation with Arbitrator i.
Brown at the Grievance Settlement Board on May 17, 2007. Failing
agreement on the remaining positions, dates for arbitration shall be scheduled '
with Arbitrator Brown.
6. This settlement is without prejudice to the positions of either party.

These Minutes of Settlement resolve the BUI issues between the parties concerning the

The parties'agree as follows:

1. The Ministry will create two full-time classified positions consistent with
Financial Analyst and FIC Spec Project in the Financial Management Branch,
and so long as the work continues to be done,will maintain such position as
AMAPCEO bargaining unit positions, and it will post and fill.such positions in
accordance with the AMAPCEO Collective Agreement not later than 90 days
from the date hereof. j

2. The engagement of non-public servants to do the work listed under 174 and 175
on the list referred to above will cease within 90 days of the date hereof.

3. The work of the following personnel in the Registration and Claims Branch (D.
Schoular, E.Dixon,F.Nagy,)and in Drug Programs(N. Visram)has been
terminated prior to the date hereof. The Ministry will not use non-AMAPCEO
personnel to perform the work performed by the persons listed above.
4. It is agreed that Robert Pharand on the list referred to above should not have been
on the list disclosed to AMAPCEO because the requirements ofthe applicable
Order did not apply.
5. The employer will pay AMAPCEO forthwith,and not later than June 15,2007,
the sum of five thousand two hundred and eighty dollars($5280.00)in full and
final settlement of the BUI issues regarding the list described above.
6. This settlement is without precedent or prejudice to the positions of either party.

7. Vice Chair Brown shall remain seized to deal with any disputes arising from this
settlement.
