TheindividualgrievanceofMsRaghubir-MamuzelosallegedthattheCollegehad violatedthecollectiveagreementbytreatingherinamannerthatwasdiscriminatory andinbadfaith.Thegrievorgaveevidenceonthefirstdayofhearingconcerningthe allegationsofdiscriminatorytreatment.Thereaftertheallegationswerewithdrawnand thehearingproceededtoconsidertheissueofwhethertherequirementthatthe applicantforthispostinghaveatleastaMastersdegreeinthefieldofstudywasa violationoftheprovisionsofthecollectiveagreement,andwhetherthegrievorhad beentreateddifferentlythanotherapplicants. TheCollege'spositionwasthatthegrievorhadnotbeendiscriminatedagainstor 3 treateddifferentlythanotherapplicants.Withrespecttotherequirementofhavinga Mastersdegree,theCollegestatedthatthepostedpositionwastoteachinanapplied programwhichhadbeenapprovedbythePostsecondaryEducationQuality AssessmentBoard(PEQAB)whichwasestablishedunderthePost-secondary EducationChoiceandExcellenceAct,2000,andthattheguidelinesrequiredthat: Allfacultyteachingcoursesoutsidetheprofessionalormainfieldofstudy (breadthcourses,whetherlinkedornotlinkedtothemainfield)(a)hold anacademiccredentialatleastonedegreehigherthanthatofferedbythe programinthefieldorinacloselyrelatedfield/disciplineand(b)nofewer than50percentofthefacultyholdtheterminalacademiccredentialinthe fieldorinacloselyrelatedfield/discipline. ThegrievortestifiedthatshebeganteachingattheCollegeinJanuary,1998.Since thattimeshehastaughtavarietyofcoursesincludingpsychology,sociologyand generalelectivecoursesandhas,atvarioustimes,hadpart-time,partialloadand sessionalteachingstatus. ShestatedthatshehasaMasterofScienceinEducationfromNiagaraUniversityin NewYorkstate,andthatsheappliedforthepostingbecause,inheropinion,shemet therequirementsbecauseshehadcredentialsinthefieldofstudyandaMasters degree. InJune,2003thegrievorwasadvisedthatshewasnotbeingconsideredforthe positionbecauseherdegreedidnotfittherequirements,specificallythatshedidnot haveaMastersdegreeinthefieldofstudy.Thegrievorwasquiteupsetbecauseshe 4 hadtaughtatNiagaraCollegeformorethanfiveyearsandanticipatedthatshewould beabletosuccessfullybeplacedintoafull-timepositioninthefieldofstudyinwhich shehadbeenteaching,whensuchpositionbecameavailable. MsSherdRosen,thePresidentofLocal242,testifiedthat,priortothegrievancebeing filed,shehadbeenawarethatasCollegesinOntariowereapprovedtoofferapplied degreesitmightmeanthatprofessorswouldneeddifferentcredentialsandthat personsmightneedadifferentkindofMastersdegreeandthataM.Ed.maynolonger beacceptable. Shestatedthatshewasconcernedabouttheimpactofthischangeonthebargaining unitandspecificallyonthenonfull-timefacultywhowerelookingtoapplyforfull-time positionsastheybecameavailable,andshewantedpersonstohavetheabilityto upgradeorretrain.Shestatedthatwhenshesawthepostingsheunderstoodthatthe CollegewasaskingforaMastersdegreeinthefieldofstudy,butstatedthatshewas relievedthattheywereconsideringaterminaldegreetobeeitheraEd.DoraPh.DI. InresponsetoquestionsfromtheCollege,MsRosenacknowledgedthatshehas knownsince2000thatapplieddegreeprogramswereintheoffingandthatthematter ofcredentialswasanissue.ShealsoacknowledgedthattheUnionhasa representativeontheBoardofGovernorsandreferencewasmadetotheMinutesof theMeetingonMay8,2003whichprovidedinpart: 5 APPLIEDDEGREES-POLICIESANDPRACTICES MarthaCassonreportedthattheMinistryofTraining,Collegesand UniversitieshasgrantedtheCollegeconsenttooffertwoapplieddegrees: BachelorofAppliedBusiness(HospitalityOperationsManagement)and BachelorofAppliedTechnology(Photonics)andthatconsentisgranted subjecttoBoardapprovalofthepoliciesandpracticesregarding admissionandpromotionandfacultyqualifications.Sheprovidedan overviewoftheminimumadmissionrequirementsandexplainedthe recentsecondaryschooldesignationofcoursesforcollegeadmission purposes.CollegePractices,"StatementonEvidenceofFaculty Credentials"and"FacultyCredentialsforAppliedDegreeTeaching"were alsodistributedtotheBoardforreview.ThePresidentexplainedthatthe CollegehasworkedwiththeBoard'sAcademicLiaison,PeggyDavidson, actingonbehalfofBruceCaughill,onthismatter. Movedby: Secondedby: P.Davidson N.Chartrand THATinaccordancewiththerequirementstooffertwoapplieddegrees, BachelorofAppliedBusiness(HospitalityOperationsManagement)and BachelorofAppliedTechnology(Photonics),thefollowingpoliciesand practices -AdmissionandPromotion/GraduationRequirements, -StatementonEvidenceofFacultyCredentials,and -FacultyCredentialsforAppliedDegreeTeaching, beapprovedbytheBoardofGovernorsandsubmittedto"theMinistryof Training,CollegesandUniversities MotionCarried Ms.MartiJurmain,theDirectorofResearchandInnovationandthepersonresponsible forthedegreeprograms,testifiedthatin2002theCollegeappliedforpermissionto offerfouryeardegreeprogramsinappliedareasofstudy.ThePost-secondary EducationQualityAssessmentBoardwascreatedtoreviewapplicationstooffersuch programsandtorevieworaudittheprogramsattheendoffouryears.Heemphasized 6 that,inordertobeapprovedforanappliedprogram,theCollegehadtosatisfythe Boardthatithadthecapacityofdelivertheprogramwhichincludedtherequirement thatallfacultyteachingthebreadthcoursesholdanacademiccredentialatleastone degreehigherthanthatofferedbytheprograminthefieldandthatfiftypercentofthe facultyholdtheterminalacademiccredentialinthefieldoracloselyrelatedfield. Ms.Jurmainacknowledgedthattherewasaprocedureforallowingexceptionstothis rule,butitwouldrequirethePresidentoftheCollegetoindicatethatforsomereason, suchasascarcityofapplicants,itwasnotpossibletomeetthePEQABrequirements. HestatedthatthegrievorhadaMastersdegreeineducationandthereforedidnotmeet thequalificationsrequiredintheposting,andsincetherewasnotascarcityofotherwise qualifiedapplicantsthiswasnotasituationwhereanoverridewasappropriate. Mr.StewartKellio,theDeanofInterdisciplinaryStudiesandAccess,testifiedthathe preparedthejobpostingandthathewaslookingtohiresomeonethatmetthePEQAB qualificationsbeingaMasters,orpreferablyaPh.D.,insociology.Hestatedthatwhen thegrievorappliedforthepositionhebelievedshehadaMastersdegreeinsociology. Therewasoneotherinternalapplicant.Hestatedthattheydecidedtoexaminewhata M.S.ineducationmeantanddiscoveredthatitwasaoneyearprogramandwasnota goodfitforteachingsociologyinanappliedprogram,anditwasthereforedetermined thatthegrievordidnothavetherequisitequalificationsandthereforeshewasnot grantedaninterview. 7 Mr.KelliotestifiedconcernedthehiringofMr.MartinDevittinanotherjobcompetition foraphilosophyprofessor.Mr.DevittdidnothaveaMastersdegreeinphilosophybut hadstudiedphilosophyfortwoyearsattheUniversityofEssexandhadbeenenrolled forseveralyearsinaphilosophyPh.D.programattheUniversityofSydney.Mr.Kellio statedthathehadspokenwithMr.Devitt'sMastersthesisadvisorattheuniversityand wassatisfiedthatMr.DevitthadtheequivalentofaMastersdegree,and,ascompared tothegrievor,hadamuchgreaterdepthofknowledgeinhissubjectarea.Hestated thatMr.Devittispresentlyonleaveofabsencecompletinghisdoctoraldegree. Mr.KellioalsotestifiedconcerningtheUnion'sevidencethattheco-ordinatorof electivesfortheappliedprogramshadapparentlyscheduledhimselftoteacha sociologycourseinthefallof2004toapplieddegreestudents,whenhedoesnothave aMastersdegreeinsociology.Mr.Kalliostatedthathehadbeenonleaveduringthe wintersemester,andthathavingbecomeawareofthesituationheintendedtocancel theteachingassignment. SUBMISSIONSOFTHEPARTIES TheUnionsubmittedthattherewasanobligationontheCollegetogivenoticeof significantchangesinqualificationsforpostedpositions.Initsview,thegrievorwas qualifiedandhadtaughtsociologycoursesattheCollegeformorethanfiveyearsand wasentitledtogoodfaithconsiderationforthepositionundertheprovisionsofarticle 27.11ofthecollectiveagreementwhichprovides: 8 27.11B Whereavacancyofafull-timepositioninthebargainingunit occursandisnotfilledinternally,theCollegewillgive considerationtoapplicationsreceivedfromacademic employeeslaidoffatotherCollegesbeforegiving considerationtootherexternalapplicants.Forthepurposes ofthisarticle,full-timeandpartial-loadbargainingunit employeesshallbeconsideredinternalapplicants.Such considerationshallbegivenforuptoandincludingten workingdaysfromthedateofpostingasdescribedin27.11 A. Considerationwillincludereviewofthecompetence,skill andexperienceoftheapplicantsinrelationtothe requirementsofthevacantposition. TheUnionpointedoutthattherequirementofaMastersdegreeinsociologywasinfact notrequired,butonlypreferredbytheCollege,andspecificreferencewasmadeto anotherjobcompetitionforaphilosophyprofessorinwhichMr.Devittwashiredwhen hedidnothaveaMastersdegreeinphilosophy.IntheUnion'sviewthishiringofMr. DevittdefinedwhotheCollegeunderstoodwouldbequalifiedbyPEQABtoteachinthe appliedprograms.IftheCollegewaswillingtogiveMr.Devitttheopportunityto completehisdegreewithinareasonableperiodoftime,itwasarbitraryand discriminatorynottogivethesameopportunitytothegrievortoachieveaMastersin sociologyiftheCollegewasnotsatisfiedwithherqualifications. TheUnionreferredtoanumberofarbitraldecisions,whichstandfortheproposition thatgenerally,selectioncriteriaareprovidedinjobpostingsinordertoallowindividuals toknowthesortofpersonsthatarebeingsoughtfortheposition,andtoprovidethe yardstickbywhichtheemployerisgoingtomeasuretheapplicants.Initsview,the 9 standardofreviewbyaboardofarbitrationofthedecisionofanemployertorejectan applicantwasoneofcorrectnessandreferencewasmadetothedecisioninReElgin CountyRomanCatholicSeparateSchoolBoardandLondon&DistrictServiceWorkers' Union,Local220,(1992)26L.A.C.(4t")204(J.B.Rose),GeorgeBrownCollegeand OntarioPublicServiceEmployeesUnion(Mellor),(1993)37L.A.C.(4t")107(K.M. TheUnionalsosubmittedthat,byincludingEd.D.intheposting,theCollegewas indicatingthataMastersdegreeineducationwouldbesufficienttosatisfythe qualification. TheCollegesubmittedthatitwasamanagementrighttoestablishqualificationsforjob postingsaslongasthequalificationswerebonafideandrelatedtothepostedposition, Inthiscase,itwasrespondingtoarequirementofPEQAB,thattheprofessorsteaching intheappliedprogramshaveatleastaMastersdegreeinthefieldofstudy.Initsview, 10 theLocalUnionwasawarethatthecredentialsrequiredofprofessorsteachinginthe appliedcourseswaschanging,andmoreover,therewasnothinginthecollective agreementwhichrequiredtheCollegetogiveanyexplicitadvancenoticetotheUnionor toindividualmembersofthebargainingunit,ofsuchchange.Referencewasmadeto thedecisionsinReWindsorRegionalHospital(WestemCampus)andOntarioNurses' Association,(1996)60L.A.C.(4th)203(R.L.Verity),ReBoardoftheTimminsPublic LibraryandCanadianUnionofPublicEmployees,Local2445,(1998)77L.A.C.(4h)83 (R.M.Brown),AlgonquinCollegeofAppliedArtsandTechnologyandOntarioPublic ServiceUnion,unreported,July13,1983,(H.D.Brown). Withrespecttoarticle27ofthecollectiveagreement,itwassubmittedthatthegrievor's applicationwassenttotheselectioncommittee,andthatitwasconsidered,andwas rejectedbecausethegrievordidnothavethequalificationsinthefieldofstudy,and referencewasmadetothedecisioninOntarioPublicEmployeesUnion,Local4200,and LoyalistCollegeofAppliedArtsandTechnology,unreported,May27,1997(M.G. Mltchnik). Further,itwassubmittedthat,whiletheremayhavebeensomeambiguityinthe languageoftheposting,itwasalwaystheintentionoftheCollegetohireprofessorsfor theappliedprogramsthatmetthePEQABrequirements,whichisaminimumMasters degreeforteachingsociology,withpreferencetoapplicantswithaPh.D.insociology, andthattheCollegehadnotactedinbadfaithinestablishingthecriteriaorin 11 determiningthatthegrievorwasnotqualified. DECISION Itisclearfromtheevidencethat,inthejobpostingforasociologyprofessorinMay, 2003,theCollegechangedtherequiredqualificationsfromhavingaMastersdegreein anydiscipline,tohavingaMastersdegreeinthefieldofstudy.Thus,whereas previouslythegrievorwouldhavemetthequalificationsbecauseshehadaMasters degreeinEducation,shedidnotmeettherevisedqualificationswhichrequiredan advanceddegreeinsociology,andthisisthegravamenofthisdispute. Thereisnothinginthecollectiveagreementwhichtouchesdirectlyontheinformation whichmustbeprovidedinajobposting,butthearbitraljurisprudenceisclearthatthe requirementsmustbebonafide,andreasonablyrelatedtotheposition,andmustnot havebeendevelopedsoastospecificallyincludeorexcludeaparticularcandidate(s). InthisregardthePanelissatisfiedthat,indevelopingthequalifications,theCollegewas respondingtothedemandsofPEQABthatprofessorsteachinginthebreadthcourses haveaMastersdegreeintheareabeingtaught,andwasalsoseekingtogive preferencetoPh.D.candidatessoastomeetthesecondPEQABrequirementthatfifty percentofthefacultyholdtheterminalacademiccredentialinthefield,orinaclosely relateddiscipline. 12 Thegrievor'sapplicationwasconsideredbytheselectioncommitteewhichdetermined thatthegrievordidnotmeettheminimumqualificationsfortheposition,andinsofaras theUnionallegesaviolationofarticle27.11B,thePanelissatisfiedthatthegrievordid receivetherequisiteconsideration..Atp.12ofthedecisioninOntarioPublic EmployeesUnion,Local4200andLoyalistCollegeofAppliedArtsandTechnology, supra,theBoardoffersitsopinionconcerning27.11Basfollows: 1)TheCollegehasanobligationtoconsiderallapplicationsatstage one,the"internal"bargainingunitstage,priortoturningtoand takingintoaccountapplicationsthatmightbebeforeitatstagetwo (considerationofexternalCollegeapplicants). 2)IftheCollege,actingingoodfaithandonthebasisofrelevant considerations,doesnotmakeaselectionforthepostingfrom amongtheinternalapplicantspresented,itmaythengoonto considertheapplicationsthathavecomebeforeitfromother Colleges(anddealwiththosemeetingtheten-daycut-offinthe samefashionasinpointnumber(1)priortomovingontoconsider anyapplicationsfromotherexternalsources. 3)AslongastheCollegefollowsthestepshereinsetout,properlyand sequentially,andthepostingnonethelessremainsunfilled,itisopen toittogobackandgivefurtherconsiderationtoanyandall applicationsthathavebeenplacedbeforeit,andtomakeafinal decisionifitchoosesfromthatentire"pool". TheevidenceinthiscasesatisfiestheBoardthatthegrievor'sinternalapplicationwas consideredinprioritytootherexternalapplicantsandtherehasthereforebeenno violationofarticle27.11B. TheUnionarguedthatthegrievormetthequalificationsinanyeventbecauseshehad 13 beenteachingthecoursesforanumberofyears,becauseshehadaMastersdegree, andbecausethepositionprovidedthat"preferencewillbegiventoanadvanced academiccreditnormallytheterminalcredentialinthefieldofstudy(Ph.D.orEd.D.), andsincethegrievorhadaMastersinEducation,sheshouldhavebegivenpreference asoutlinedintheposting. InthePanel'sview,whiletheremaybesomeconfusioncausedbythewordingofthe sentenceestablishingthequalifications,theintentionoftheCollegewastomeetthe PEQABrequirementsandtohirepersonswithaMastersdegreeinthefieldofstudy, andtogivepreferencetopersonsholdingaterminaldegreeinthefieldofstudy,which, inthecaseofsociology,wouldbepreferencetoanapplicantwithaPh.D.insociology, andinthecaseofeducationwouldbetoanapplicantwithanEd.D..Thus,anobjective reviewofthegrievor'squalificationsdisclosesthatshedidnotmeettheminimum qualificationsofthepostedpositionandherapplicationwasproperlyrejected. Someofthemisunderstandingsurroundingthispostingcomesperhapsfromalackof communicationwithbargainingunitmembersconcerningchangesinthequalifications requiredtoteachinthenewlyapprovedapplieddegreeprograms.Therearemany professorswithMastersdegreeswhohavetaughtforanumberofyearsonpartialload orpart-timeteachingcontractswhoexpectthattheyarequalified,andwillbehired, whenafull-timevacancyoccurs,andthegrievorisonesuchperson.Shehasbeen teachingsociologycourses,includingmanyofthecoursesmentionedinthejobposting, forfiveyears,anditmusthavebeenaconsiderablesurprisewhenshewasnoteven 14 interviewedforthepositionoffull-timesociologyprofessorinMay,2003.Greater communicationpriortothepostingmayhavealertedthegrievor,andothers,ofthe changeinqualificationsandgivensuchpersonstheopportunitytoupgradetheirskills and/oracquirefurtherdegrees,andgreaterspecificityinthepostingwouldhavealso alertedpotentialapplicantsastothequalificationsfortheposition. Despitethesecomments,thePaneldoesnotfindinthecollectiveagreementany expressrequirementthattheCollegenotifyindividualbargainingunitmembersof potentialoractualchangesinthelanguageofajobposting,andthePaneldoesnote thattherewassomecommunicationwiththeUnionconcerningthispossibility. AfurtherdifficultyisthattheEmployerhiredMr.Devitttoteachphilosophycoursesin theappliedprograms,whenMr.DevittdidnothaveaMastersdegreeinphilosophy.It maybethatMr.DevitthadtheequivalentofMastersdegree,butitisourunderstanding thatthepostingrequiredthesuccessfulcandidatetohavebeenawardedadegree. Further,theCollegeapparentlygaveMr.Devittaperiodoftime,andaleaveofabsence, tocompletehisPh.D.. WhileitmaybethatMr.DevitthastheequivalentofaMastersdegreeinphilosophy,if theCollegewaspreparedtoconsiderequivalency,ortogiveapplicantsaperiodoftime toachievesuchequivalencytheycouldhavemadethisclearsothatapplicantsforfull timeteachingpositions,wheresomeoralloftheteachingwilltakeplaceintheapplied programs,donotfeelthatthereisdifferentialtreatmentacrosstheCollege. 15 Further,theevidencethattheCo-ordinatorofElectiveswasplanningonteachinga sociologycoursetoapplieddegreestudentsinthefallof2004whenhedidnothavea Mastersdegreeinsociology,givestheimpressionthattherequirementtohavean advanceddegreeinthesubjectmatterbeingtaughtiseithernotwellknownthroughout theCollege,orisnotbeingenforced,againleavingtheimpressionthatthereis differentialtreatment. ThesetwoexamplesindicatetothePanelthat,consideringtheimportanceoftheissue toexistingfaculty,therewasinsufficientattentionpaidtoadvisingthefacultyofthe pendingchanges,andinsufficientattentiontothewordingofpostings,andtoensuring thattherewasequaltreatmentofapplicantsacrosstheCollege,andtheCollegeis directedtobemorepreciseastothequalificationsbeingrequested,andtobemore rigorousinapplyingthequalificationsconsistentlywithintheCollege. WithrespecttotheindividualgrievanceofMsRaghubir-MamuzelosthePanelis satisfiedthattheCollegehadbonafidereasonsforrequiringaMastersdegreein sociologyfortheposition,thatthegrievorreceivedconsiderationasaninternal candidate,andthatherapplicationwasproperlyrefusedbecauseshedidnotmeetthe qualifications.Thegrievanceisthereforedenied. HadCollegeoflieialsbeenmoreforthrightwithIhegrieveraaldtreatedherinthe samemannerasMr.Devitt,shewouldhavehadtheopportunitytodecidewhethershewantedIoperauefitrtherstudiesandbecomefullyqualifiedasperthePost.secondaryExJucation QualityAssessmentBoard(P.E.Q.A.B.)requirements. WhiletheCollege".aetlonswerenotdiscrJminat,:,ryinthelegalsense,itisunderstandablewhythegrieverfeltshewastreatedinmnnthtrmannercomparedwiththe treatmentaffordedtoMr.Devitt, TheCollege'sactiongivestheimpressionthatitwantsitbothways;thatis,tointerprettheP.B.Q.A.B.requirementswithflexibility-literally,inotherwords,toitsbeJlefit,buttothedetrirlentofthegriever.
