AWARD TheBoardhasissuedtwointerimawardsconcerningthisgrievancewhichisdated March24,2003andconcernstheallegedviolationbytheCollegeofArticle2.02ofthe collectiveagreement.TheUnionseeksadeclarationthattherewasafu!I-timevacancyin theBusinessStudiesDivisionintheWinterTermof2003andthatRickBurjawemployed atal!materialtimeaspartialloadshouldbeawardedajobpostingforafixlI-timeposition. TheGrievorwasapartialloademployeewhotaught12hoursperweekinMarketing since!987anduntilthesummerof2004whenheacceptedemploymentattheUniversity ofWesternOntario. Article2.02ofthecollectiveagreementis: "'2.02TheCollegewilIgivepreferencetothedesignation offull-timepositionsasregularratherthan partial-loadteachingpositions,asdefinedinArticle26,Partial-LoadEmployees,subjecttosuchoperational requirementsasthequalityofthe programs,attainmentoftheprogramobjectives,theneedforspecialqualificationsandthemarketacceptability oftheprogramstoemployers,students,andthecommunity." Followingthecompletioninthesubmissionsofcounselforpa)ties,theBoardmet inexecutivesessionatOakvilleonMay18thtoconsidertheevidenceandtheissuesraised inthismatterandthepreparationofitsawardwhichissetoutherein. TheGrievortestifiedthathejoinedthefacultyin1993asaPart-TimeInstructorin theBusinessStudiesDivisionandatvarioustimeshewasalsoaSessionalandPartial LoadProfessorwhichcategoryheheldinthefallandwintertermsof2003/04.Primarily •••"*rd hetaughtaduatmgstudentsmtheror44yearinthemarketingprogramofthe BusinessStudiesDivision.Hetaughtthefollowingcourses:-"IntroductiontoBusiness Processes(BSNS220),GlobalMarketing-570,IndustrialMarketing572and MerchandisePlarmingII(420)whichhadasecondsection.Intotalhehad12hoursof teachingperweek.Inthefallterm200t,hetaught220foronesemester.TheGrievor referredtothetimetableofH.Hallettwhoalsotaughtinthemarketingprograminthefall 2001,for12hoursonthatschedulehewasavailabletoteachBSNS220forthreehoursin totalInthespringterm2002,hesaidhealsocouldhavetaught220forthreehours whichwereassiedtoHallett.Inthefailterm2002,hetaughtthefollowingcourses: PrinciplesofAdvertising(340),BSNS220,ProjectManagement(364),GlobalMarketing (570),forthreehourseach. Thegrievancepertainstothewinterterm2003inwhichtheGrievortaught MarketingManagement(308),SalesManagement(425),Not-for-Profit(629), MerchandisePlanningII(420)foratotalof12hours.TheGrievorreferredtothe imetablesforGtals,ThornbyandMoriI1toindicatethathewasavailabletoteach220for atotalof5hourswhichhadbeenassig-nedtotheotherteachers.Inthefallterm2003,he referredtofourhourswhenhewasavaiIabletoteach220whichhadbeenassignedt9 others.Hesaidthemostdifficultcoursestoreschedulehavemulti-sections,theeasierare theselfcontainedthirdyearcourseswithafixedtimetablesuchasInternational 4 Marketing,NotforProfitMarkeingandAdvancesellingandtaughtonesectioneachfor thirdyearMarketingstudents.MerchandisePlanning(420)isa4tusemestercoursewith foursections.HesaidhehadspecialexpenseinGlobalMarketingandwasnotawareof anyNil-timeteacherswhotaughtthatcourse.Hesaidinthefall2003,therewasa vacancypostedforaFull-TimeMarketingProfessortowhichhehadappliedbutwas unsuccessfulandthepositionwasawardedtoanotherPartialLoadteacher,Ms.Hillier. FollowingwhichthereweretwomorevacanciesinMarketingin2004buthedidnotappty foreitherashehadnotbeensuccessfu!intheearlierposting.Althoughhehadthe backgoundandteachingexperience,hedidnotthinkhewouldbesuccessfulinthese postfngsandaIsohadreceivedacontractattheUniversity. TomGeldardproducedachartoftheFacultypositionsinBusinessStudiestaken fromthebudgetdocumentsoftheCollegewhichshowtheFull-Timecomplementaswell asPartiaILoadwhichforthewinter2003was39Ful!-Timeand1tPartiaILoadwith10 inthefall2002and14infail2003.Infall/winterterms2001/02,therewere40Full-Time and9and6PartialLoadteacherswithanaverageof39Full-Timefacultywith14.25 teachingcontacthoursperweek.Hesaidthatafterthisinformationwasreceived, Ms.HiIllerwashiredasaFull-TimeProfessorinMarketingandhadbeenPartialLoadin thefailandwintertermsof2003.TheaveragetakenfromtheMinistry'sworldoadsurvey byMr.Fordyce,indicatedanaveragecontacthoursperweekintheCollegesexcluding Coordinatorswhohavecomplementarytimeassignedforthattask,was14.3in2000/01. 5 DavidBalfourisChairoftheBusinessDivisionwhichincludestheMarketing Program,reviewedtheCurriculumfortheBusinessAdministratiorgivlarketlngProgram withsixIcvisofinstructionwherethetwo-yearprogramstopsataLevi4andthose studentsgoingontothethree-yeardegree,continuewithlevis5and6,BSNS220is includedinLevel1andwastaugjtbyBurjawwhoatsotaughttheNot-For-ProfitCourse inseveralsemesters.NoPuI!-TimeteacherhasdeliveredthatcoursewhichisatLevel6, thefinalyearofathree-yeaproamandBmjawtaughtthiscourseinthewintertermof 2004.ItwassubsequentlytaughtbyMaryPierce,aFull-TimeProfessorasof Augnst2004whobadbeenhiredintheMarketingProgrampriortowhichshewasa PartialLoademployee.Becauseofherexperienceworkinginanon-profitorganization, shewasassignedinthewinterterm2005toteachthiscourse. knthewinterterm2003,MerchandisePlanning,alevel2course,wastaughtfor manyyearsbyProfessorSutherlandwhowasFull-Timeandwhotaughtmostofthe sectionsofthatcourse.SubsequentlyMs.Gray,amorerecentPul!-TimeProfessortaught bothcourses.ShewasalsotheCoordinatorofMarketingandBusinessPurchasing.in thatsemester,eightcomplementaryhoursperweekwereassignedtoSutherIandwhich takesawayfromthenumberofcourseshecouldteachinaweekbecauseofhisco ordinatortask.Similarly,ProfessorGraywasassigned12hoursforcomplementary functionsinaweekinvolvingtwosectionsofMarketing,207.Shealsohadfourhoursof ProgTamDevelopment.BetweenthesetwoProfessors,Mr.Balfoursaidtaughtsix sectionsof207.OnesectionofMerchandisePlanningwastaughtbyBurjawbuthadit notbeenfortheirCoordinatorduties,bothfail-timeteacherswouldhavetaughtthewhole coursewhichisstillbeingoffered.SutherlandretiredinJune2004andinAugust, Ms.Graytookmaternityleave.L.LynchwashiredasaFull-TimeProfessorinMarketing commencingtheFallTerm2004andtaughtseveralsectionsofMerchandisingincluding thesectionspreviouslytaughtbySutherlandandGray-whoreturnedtoworkinNovember 2005.ShewasrepIacedasMarketingCoordinatorinMay2004byT.Hillierwhohad beenhiredasaFull-TimeteacherinJanuary2004inMarketingpriortowhichshehad beenPartialLoad. Ms.Pearcewashiredasafail-timeteacherafterSutherlandretiredinthesummer 2004.LynchistheCoordinatoroftheSeniorMarketingProgramandHilliera coordinatorofthethirdyearprogram.Inthefallterm2003,bothSutherlandandGray whowerethenCoordinatorstaughttwosectionseachofthethirdlevelMerchandising courseswithsixhoursofteachingplustheirCoordinatingdutiesandProgram Development.Inthesameperiod,Burjawtaughtthethirdsectionof420whichcouldnot beassignedtootherfall-timeteachersbecauseoftheircomplementaryworkas Coordinators. Mr.BalfourstatedthatGlobalMarketing(570)istaughtatLevel5inthefirst semesterofthethirdyearinonesectionwhichtheGrievortaughtseveraltimesincluding thefallsemester2003,ashewasthemostqualifiedteachertheyhadandnoFull-Time ProfessorshadthattypeofexperienceforthatcoursewNchwastraditionallytaughtinthe fallsemester.Inthefo!lowingfailsemester,MoeAbouwashiredtoteachthatcoursefor 7 onesemesterasaPartialLoademployeeandsubsequentlyitwastaughtin2005by anotherPartialLoadProfessor. Inthewinterterm2004,theGrievorwasassignedtoteachtheNot-For-Profit MarketingCourseasnootherNil-timeemployeeshadhisexperienceandhadpreviously tauat.Inthesameterm,theGrievortaughtthefifthsectionofSmallBusiness Management(513)inplaceofJohnShore,aFuI1-TimeProfessorwhowasonareduced workloadformedicalreasonsbuttaughtfoursectionsofthatcourse.Mr.Balfoursaid thatProfessorSutherlandrevertedtoafailteaching!oadinthenterterm2004. ProfessorGraytaughttwosectionsof207alongwithherotherdutiesasCoordinator. BnijawtaughtonesectionofRetailMerchandiseManagementinthatterm.Hesaidthat BSNS220hasnotbeenofferedintheMarketingProamfortwoyearsbutinthefailof 2004wasofferedintheBusinessInsuranceProgramandtaughtbyaFull-TimeProfessor atthattime. DennisSullivanretiredin2003andDaveSutherlandretiredinthesummerof 2004.IntheMarketingProgram,Mr.Balfourreferredtothefollowingpersonsappointed asFull-Timestaffsincethewinterterm2003:T.Hiilier,L.LynctM.Pearce,M.Sloane; K.Thompson,C.Hubert,thelatterthreehadbeenPartialLoademployees. Mr.BalfouraeedthattheGlobalMarketingCourseofsixhourswasassignedin thefall2005toaPartialLoademployee,M.Morgan,andhadpreviouslybeentaughtby BurjawwhowasamarketingProfessorwithmanagementexperience.Hetaughtwithin themarketingcurriculumandFinancialServiceswhereHallettandAndreaswereassigned onesectionforthreehourseachofBusiness1005inthefallterm2005butsaidthiscourse isnotpartofthemandatorysectionsinMarketingbutisintheFinancialdivisionas IntroductiontoBusiness. Inthefall2003,theGrievortaughtPrinciplesofMarketing(206)whichagainwas offeredaiderachangeofsystemsin2005andninehoursassignedtovariousteachersin15 sectionsforatotalof45hours,someofwhichwereassigmedtoPartialLoadstaff. D.Chapman,aPartialLoadteacherinMarketingandK.Wflliamson,taughtthreehours eachweekof206inthefailterra,2005.Atthattime,!6staffmembersjoinedthe MarketingDepartment.SixhourseachofMerchandisePlanning(420)wereassignedto twoPart-Timeemployees.Mr.BalfoursaidthatintheBusinessStudiesDivision,each programhasaCoordinatorwithtwointhemarketingprogramallofwhicharemembers ofthefail-timestaffandwhosedutiestakeawayfomtheirteachingtime,that requirementisanon-goingstaffconsiderationthroughtheyearaslongasthatprogramis offered.HesaidthattheMerchandisePlanningcoursestaughtbythetwopart-time teacherswouldhavebeentaughtbyMs.Graybutwhowasonmaternityleavewhenthese twopersonswerehired. TheUnion'spositionisthattheBoardshoulddeclareaviolationofArticle2ofthe collectiveagreementandthatafail-timepositionbepostedintheBusinessStudies DivisionandthatpositionbeawardedtoR.Burjaw.TheUnionhasmetitsonustoshow thattherewassufficientworktojustifyafail-timepositionintheDivisionbycobbling teachingassignmentstogether.TheUnionreliesinthatregardonReSt.Lawrence CollegeandOPSEU(Shime,May18,2005)andReAIonquinCo!le_eandOPSEU (I{nopfMay27,2003)asadoptedbythisBoardinffspreliminarydecisiondatedAugust 17,2004.ItwassubmittedthattheCrrievorhad12hoursofteachingwhichisonlytwo hourslessthantheaverageofwhatafuIl-timeteacherisrequiredtoteachaccordingto thebudgetdocumentoftheCollegeandtheacademicworkloadsurveyintheColleges. WithinthespiritofArticle2,theGlievorcouldhavebeenassignedonemorecourseofthe workavailabletomakeafull-timepositionsuchasBSN220whichhehadtaughtinthe fal!term2002.ThatcoursewasofferedconsistentlyandwastaughtbyotherPartialLoad Instructorsbywhichtheaddedteachingtimewhichissufficienttojustifyafull-time position.Inthewinterterm2003,therewere18hoursavailableforteachingBSNS220. Further,therewasadecreaseintheFull-TimecomplementintheBusinessDivision betweenthefal!2001and2003,butwithanincreaseinthePartialLoadstaffwhich indicatesthatthebodyofteachinghadnotshrunkbutwasstillrequiredyettheCollege chosetohiremorePartialLoademployeesforthatwork. TheGrievorhadspecialqualificationsintwoareasofNot-For-ProfitMarketing andGlobalMarketingwhichcannotbecountedtosatisfytheoperationalrequirement provisoofArticle2.02becausetheColIegemust#vepreferencetoNl!-timepositionsnot filledjustbyexperts,toteachuptoa12-hourlevel.ReHumberColleeandOPSEU (R_.D.Howe,April12,1994).WhiletheGrievorhadspecialqualificationsinthese courses,hewaswillingtoacceptandwantedafull-timeposition.Healsohadmoreskills andhadtaughtinotherareasthanthesetwocoursesasshowninthewinterterm2003 I0 withMerchandisePlanning(420)andSalesManagement(425)whichdonotneedspecial expense.ThereforetheCollegecannotrelyonoperationalrequirementsofspecial qualificationsforafull-timeposition.Changesinthefull-timestaffingcamefromthe Coordinatortasksofthefull-timeprofessors.Thereisanon-goingrequirementtoadjust fortheeightCoordinatorsintheBusinessDivisionwhohavereducedteachingdutiesasa result,kisnotconsistentwiththetermsofArticle2toallowtheCollegetohirePartial Loademployeestotakeupthoseteachingrequirementswhichwerereducedfromthe scheduleofthesecoordinators. Inthea!temativehwassubmittedthateveniftheBoardfoundthattherewasa validoperationalrequirement,itshouldnotbeappliedastheGrievorreceivedtwo additiona!coursesinthewinter2003notpreviouslytaughtbyacurrentCoordinatorwere withinhisexpertiseandonlyoneofwhichhadpreviouslybeentaughtbyaCoordinator (420).IftheteachingdutiesofaCoordinatorareaffectedandisconsideredjustifiable requirementfortheoperations,theGrievor'sassignmentswouldhavebeenlimitedto meetingthoseoperationalrequirements.ItwassubmittedthattheGrievor'steaching assigmmentsdonotreflectsuchassignmentsbutgobeyondwhatisnecessarytomeet operationalrequirements.RistheUnion'ssubmissiontherewasworktojustifythe creationofafull-timepositionandtheCollegeshouldnotbeallowedtorelyonspecial qualificationsofateachertosatisfyoperationalrequirementsinordertocoverprior teachingassignmentsofaCoordinator. 11 Further,hwassubmittedthatalthoughtherehavebeensevennewfull-time professorshiredwithsixinMarketing,betweenthewinter2003andsummer2005,there stillexistsasignificantportionofhoursbeingtaughtbyPartialloadteachersinthe BusinessStudiesDivisiontotalingonitsevidence,I17teachinghourssothatevenwith thenewhires,therewasworkforaFul!-TimeProfessor.Thecourseswhichhadbeen taughtbyMr.BmjawarebeingtaughtbyPartialLoadstaffforatotalof24hourswhich areavailabletomakeuponeful!-timeposition,inadditiontothehiringofsixfal!-time staffinMarketing. ItisthesubmissionfortheCoIlegethattheUniondidnotmeetitsonusto establishthatthereissufficientworktoconstituteanon-goingfull-timeposition. Ahernatively,itwassubmittedthattheCol!egehadoperationalrequirementstoremove thepreferenceinArticle2.02.Further,theBusinessDivisionhasfundamentallychanged since2003sothatnoremedialretiefshouldbeorderedinthattherehavesincethe N'ievancebeenfulI-timestaffappointmentsintheMarketingproam.Thegrievance concernsafull-timepositionbeingavailableinthewinterterm2003tobef!lledandposted butitisnotthatMr.Burjawshouldbeawardedthejobastheissueisnotwhetheran individualhastheentitlementtoaifll-timepositionbutrathertheoniyremedypursuantto Article27.11(a)ispostingofafiilI-timeposition. ItwassubmittedthattheDepartmentchangedafterBmjawleftin2004sothatthe evidenceofwhathemighthavetaughtinthefollowingtwoyearsisnotrelevant.Toadd teachinghoursinonetermtothe12hourswhichBurjawformerlytaughtasaPartialLoad 12 employee,doesnotjustifyafuji-dineposition.Thestatisticsconcerningtheaverage contactteachinghoursintheBusinessDivisionarenotrelevanttothedeterminationunder Article2noristhedecreaseoverthreeyearsofFull-Timestaff'withanincreaseshownin PartialLoademployeesrelevantanditshouldbenotedthatsixfull-ffmeappointments weremadeinMarketingsince2004whichisthefocusofthisgrievance. ItistheCollege'spositionthatinthewinterterm2003,Mr.Burjawhad12hours ofteachingasaPartial-LoademployeeandbyaddingonesectionofBusinessMarketing forsixhoursinonetermdoesnotmakeafull-timepositiontoexist.TheGrievortookthe placeofFull-Timefacultywhowereonleaveorassignedtootherdutiesasco-ordinators andwhenhelefttheCollege,hiscourseswerepickedupbyfull-timeteachers. CoordinatorsinproarnshaveareducedworkloadbuttheirregularworkbeingrepIaced ispartofthefull-timecomplementanddoesnotconstituteanewfuIt-timepositionorpart thereofandcannotbecountedforthatpurpose.ReSt.LawrenceColIeeandOPSEU (D.D.Carer,June13,1997). Partial-loademployeesareassignedtofillgapsbecauseofmedicalleavesor Coordinatordutiesoffull-timestaffwhichtheGrievorfilledinthewinterterm2003for onesectionof420wkicbexceptfortherelieftimerequired,wouIdnothavehadthose threehoursofteaching.SimilarlyhadMs.Grasnothadareducedworkload,shewould havecoveredalongwithSutherland,thetwoMerchandisingcourses.Mr.Bmjaw replacedtheteachingdutiesinconnectionwith207and420ofthosefu!l-timeteachers andtherefore,nofull-timepositionwasshowntoexistinthatterm. 13 Aswell,theOrievorreplacedonesectioninthewinter2004oftheSmallBusiness coursetaughtbyShorewhowasonareducedworkload.Theothertwosectionsflowed 9omthedutiesofGrahamSutherlandofsixhourseachsothatpriortothedatewhen Bur]awlefttheCollege,therewasnofull-timepositionavailable.T.FalllerwasaPartial LoademployeeinJanuary2004andwassuccessfulforthejobpostingforaull-time positiontowhichMr.Burjawhadappliedbutwasunsuccessfu!.InAugust,Ms.tffilller becameaCoordinator.Atthattime,twofurtherfifll-timeprofessorswerehiredtoteach inthefall2004forcourses420and207.WhenMs.Hillierwentonmedicalleave,Lynch becameaCoordinator.Aswell,MaryPearcewashiredinMarketing. ItwassubmittedthatcourseswhichweretaughtbyPartialLoademployeestofill inforfuli-timestawhohadreducedteachingassignmentsoronleavesdonotcountto establishanewFulJ-fimeposition.Further,theOrievorhadspedalexpertisetoteachtwo courses,GlobalMarketingandNot-For-ProfitwhichafterhelefttheCollege,aPart-Time employeetaughtGlobalMarketingforonetermandintheNot-for-Profitcourse, MaryPearceasaFull-Timeteacherwasassignedtothatcourseinthewinter2005. Mr.Burjawdidhavethespedalqualificationstoteachthosecoursesandnooneelsein the£ulI-fimefacultyhadthatqualificationsothattherewasagoodbusinessreasonforthe CollegeactingingoodfaithtohaveaqualifiedPartialLoademployeeteachthosecourses, anddistinguishedinthesecircumstancesthedecisioninHumberCollee(supra)which dealtwithagenericgrievanceconcerningstaffinginthewholeBusinessDivisionover threesemesters. 14 ItwassubmittedthattheBoardshouldgivepreferencetotheCollegein determiningitsoperationalrequirementswherethereisabonafiderationaleandshould notsecondguessitsdecisionwithoutclearandconvincingevidencethattheCollegemade awrongdeterminationofitsoperationalrequirements.ReFanshaweColleeandOPSEU (McLaren,May2,1995)theJ.R.ApplicationinthatcasewasdismissedbyDivisional CourtJune19,t996. TheUniondidnotshowthattherewasafixll-timepositionavailableandwhich wascontinuedtobeworkedbyaPartialLoademployeeandcannottrackafull-time positionfromMr.Burjaw'sassignmentsto2005asthechainwasbrokenbythefallof 2004.TheIntroductiontoBusinessCoursewhichtheGrievortauatin2003was eliminatedfrommarketingbutcontinuedintheBusinessStudiesDivisionandfrom2004, thecoursewastaughtbyaFull-TimeProfessor.TheUniondidnotshowacontinuing ful!-timepositioninthenatureoftheworkwhichhadbeenassignedtoMr.Burjawand thegrievanceshouldnotbeallowed. IntheBoard'sfirstInterimAward,itreferredtoandadoptedthepositionof ArbitratorKnopfastotheapplicationofArticle2ofthecollectiveaeementandfound thattheprimaryonusisontheUniontodemonstratethatthereweresufficienthoursof workintheBusinessStudiesDivisioninthewintertermin2003whenwiththeteaching assignmentsofRickBurjaw,thetotalwouldconstituteafull-timepositionandthat evidenceofteachingassignmentsofotherPartialLoademployeesinthatDivisionatthe 15 timeofreferenceisrelevant.Thatfindingindicatesatleastthefirststepintheprocessof examinationoftheissuebyreferencetotheparticularwinter2003termatissue.Aswell, °•O.• theBoardhasreviewedthecircumstancesoftheGrievorsteachin=asslgmmentstothe pointofhisdeparturefromtheCollegewhichmayalsobeconsideredalongwiththe precedingteachingtermsasrelevanttotheteachingrequirementsforthecoursesoffered bytheCollegeduringthefallandwintertermsofthe2003academicyear. TheevidenceoftheGrievor'steachingassigmmentsalongwiththoseoftheother PartialLoademployeesinthosetermsisrelevanttotheinitialissueofwhetherafull-time positionwasshowntohaveexisted.Thesubsequentevidenceconcerningteaching assignmentsinthefollowingtermsof2004/05wereadmittedasmightbeconsideredasto remedialreliefbutinviewoftheBoard'sconclusioninthisdecision,itisnotnecessaryfor theBoardtoconsidertheeffectifany,ofsuchsubsequentteachingassigmems.The Board'sfocusisthereforeinitiallydirectedtothetimeofteachingassinmentsofthe G-rievorinthe2002/03/04periodsasfoundintheBoard'ssecondpreliminaryawardthat whatoccurredintheBusinessDivisionbothbeforeandafterthega-ievance"isarably relevanttothepurposesofmeetingtheonusoftheUnionandthegmievancesubjectof coursetotheweightwhichtheBoardmayvetosuchevidencetotal". Uptothewinterterm2003,theGrievorhadbeenassiedtoteachineach semester,GlobalMarketing(570),IndustrialMarketing(572),MerchandisePIanning1I (420),MarketingManagement(308),Not-For-Profit(629),RetailMerchandising(207), PrinciplesofAdvertising(340),ProjectManagement(364)andtaughtatotal12hoursin !6 eachweekwithinthedefinitionofaPartialLoademployeeinthecollectiveaeement. Similarlyinthewinterterm2003,hetaught12hoursinaweekinMarketingManagement (308),SalesManagement(425),Not-For-Profit(629)andMerchandisePIanning(420). Inaddition,theGrievorhadtaughtIntroductiontoBusinessProcesses(220)inthefail term2002,fortwosectionsofonehoureach.Inthoseterms,inrelationtootherPartial Loadteachers.Ms.HalIetttaughtBSNS220foreightsectionstotheendofDecember 2002.In2003,sixsectionswereassignedtoBlais,twosectionstoHombyandsevento MorrilI,allPartialLoadteachersatthattime.Ofthoseteachingsections,theGrievorwas availableinaccordancewithhisscheduleinthewinterterm2003,atotalof8sections whichwerenotinconflictwithhisscheduledteachingassignents. Fromthatassessmenthowever,wefindtheremustbedeductedtheamountof teachingtimetowhichtheGrievorwasassignedtocoverpartoftheworkloadoftheFuII TimeProfessorswhowereCoordinatorsoronmaternityandmedicalleavesasthose coursesbutforsuchreasons,wouldhavebeentaughtbyfull-timeemployeesandtherefore arenotpartofthemixoftheotherrelevantteachingassignmentstoPartialLoadteachers inMarkedng.ThereductionofteachinghoursofaFuI1-TimeProfessorbecauseofthe assignmentofcomplementarydutiesasaCoordinator,ProfessionalDevelopmentorby reasonofspecialleavesandthereplanementforsuchteachinghoursproternbyaPartial Loademployeedoesnotcounttoshowanexistenceofafull-timepositionasthose teachingassignmentsaretemporaryandbutfortheseparticularcircumstanceswouldhave beentaughtbyfu!l-timestaff. 17 Inaddition,therewerethetwocourses,Not-For-ProfitandGlobalMarketing whichtheGrievortaughtbecauseofhisparticularexperienceandexpertiseinthose subjectsandhadnotbeentaughtbyanyFuli-TimeteacherbeforetheGrievorlefthis employmentwiththeCollegein2004.Itwasthereforereasonableintherequirementsof theCo!tegetocontinuethesecoursesbyPartialLoademployeeswithsimilarexperience toMr.Buajawunti!aqualifiedFull-TimeTeacherwashiredin2005andthereforenot inconsistentwiththetermsofArticle2.02. Withthecomparisonoftheotherpartialloadprofessorsinthewinterterm2003,it appearsthatwithadditionalhoursof220availabletotheGrievorlesshisreIiefteachingin 420,thereisapossibleadditionoftwoteachinghourstohisteachingscheduleinthatterm whichwouIdjustmatchtheaverageteachingcontacthoursforFullTimeemployeesinthe Colleges.Tofindhowever,thattherewasafu!l-timepositionavailabIeintheMarketing cannotbeascertainedbythesimplemethodofcalculationofteachinghoursinoneterm butrathertherequirementsoftheMarketingProgramforteachersintheFall2002, WinterandFallterms2003andWinterterm2004arerelevanttoassesstheoperational requirementsoftheCollegeasrequiredbythetermsofArticle2.02(A). BasedontheevidencetheBoardhasconsidered,wecannotconcludethatthere wasaFull-Timeteachingpositionavailableinthewinterterm2003intheBusiness Sit'diesDivisionandmoreparticularlyintheMarketingProgramofthatDivisionwhere Mr.BurjawwasemployedasaPartialLoadprofessor.Thereductionofteachinghoursof 18 aFuII-TimeteacherasaresultofcomplementarydutiessuchasthatofaCoordinatoror onmedicalormaternityleaveswherebytheirregularteachingcourseshavetosomeextent orentirelybeenreplacedproternbyaPartialLoadsessionalteacherdoesnotindicatethat aful!-timepositionexistsasbutfortheparticularcircumstancesofthoseFull-Time Professors,theywouldhavetaughtthosecourseswhichwereassignedtemporarilyto Burjawandothers.Wefindthatthosecircumstancesfalldirectlywithintheapplicationof theprovisoforoperationalrequirementsoftheCollegeassetoutinArticle2.02toobtain theprogramobjectivesbymaintainingappropriatecoverageoftherequiredcoursestobe taughtwithintheMarketingProgram. Further,Article2.02referstothequalityofProgramsandtheneedforspecial qualificationswithintheconsiderationoftheoperationalrequirementsoftheCollegeand hereincontrasttotheHumberCollegeaward(supra),RickBurjawhadacknowledged personalspecialexperienceandqualificationsinbothNot-For-ProfitandGlobal MarketingcourseswhennoFull-TimeProfessorswereexperiencedtoteachthose particularcourses.TheCollegedecisiontoassignthosecoursestotheGrievorwas reasonablybasedandbonafideforthepurposesofitsoperationsandthequalityofthe ProgramwhichwasofferedinMarketing.Professorswithspecificexpertiseashadthe GrievorinthesetwocourseswhichwererequiredbytheCollegeintheMarketing ProgramfallswithinitsexpressconsiderationofthequalityoftheProgramsandtheneed forspecialqualificationsaswellasmarketacceptabilityinitsoperations.Thesefactors aretheveryexplicitpartsoftheconsiderationtobeventowhethertheCollegewas requiredtogivepreferencetothedesignationofFulI-Timepositionsinaccordancewith 19 Article2.02areclearlywithinthediscretionoftheCollegetodetermine.Theevidenceof Mr.BalfourshowsthatappropriateconsiderationhadbeenventotheProgramquality andMarketacceptabilitybytheuseofthespecialtalentsoftheGrievorintheseareasof teachingwherehehasspecialqualifications. AsindicatedintheAionquinCollegeawarddealingwiththeapplicationof Article2whichasstatedinourInterimAwardappliedtothepresentgrievance°theUnion mustdemonstrate"sufficientworktojustifyfilIingafull-timepositionandoncethatis done,toturntotheCollegetojustifyanypartialloadorsessionalappointmentsasfaliing withintheoperationalrequirements".Firstlywithintherelevanttimewhentheteaching assignmentsintheMarketingProamofthepartialloademployeesareassessed,thereis onthesurface,byjugglingsometeachinghoursofotherpartial!oademployeeswiththe Orievor'sschedule,itispossibletoconstructenoughteachinghourstomatchtheaverage teachingcontahoursoffull-timestaff.However,thatmathematicalexercisedoesnotby itselfsatisfythequestionofwhethertheCollegeisrequiredtoNveapreferencetothe establishmentofafull-timepositioninplaceofRickBurjaw,aPartialLoademployeein thewinterterm2003.Thatprefermentisstrictlyconditionedbytheoperational requirementsoftheCollegeasparticularlysetoutinArticle2.02asindicatedabove. TheBoardhasconsideredtheevidencewhichappliestoeachofthequalifications toprefermentoiafull-timepositionandfindsthattheCollegehasmetitsburdenof explanationfortheemploymentofRickBurjawasPartialLoadandnotFull-Timeasthere wasnotsuchapositionrequiredtobefilledintheWinterterm2003.AFull-Time 2O positionwaspostedinJanuary2004towhichtheGrievorappliedbutwasunsuccessfulin obtainingandfurtherpostingsforfull-timepositionsarosesubsequentlybuttowhichthe GrievordidnotapplybeforehelefttheCollegeinthesummer2004.Inall,sixfuIl-time positionswereNledfortheMarketingProamsubsequenttothecircumstancesofthis -ievancewhichindicatesasubstantialchangeinthestaffingcomplementoftheBusiness StudiesDivision.Howeverthatmaybeseen,ithasrelevanceonlytoaremedialissue whichasaresultofthedecisionofthisBoarddoesnotariseinthisgrievance. WhattheGrievormighthavetaughtafterhelefttheemploymentoftheCollegein 2004isspeculativeandthereforetheevidenceofteachingassignmentsinthefai!term 2004andin2005whileadmittedatthehearing,canbegivennoweitindecidingthe issueofthisgrievance.Furtherwefindthattheaverageoftotalcontactteachinghoursin theDivisionissubjecttotoomanyvariablesandisnotareliableindicatorforthepurposes ofArticle2issues.TheGrievorasaPartialLoademployeewasassignedtoteachcertain coursesinreplacementoffuli-timeteacherswhohadareducedworkioadorabsenton medicalleaveincludingtwocoursesregnlarlytaughtbyMs.GreyandD.Sutherlandfora totalofsixsectionsof207andoneof420.ThesedutiesassignedtotheGrievorfromthe Full-Timeemployees'schedulesofteachingcannotbecountedtoshowthatafull-time positionexistedin2003asthesearecleartyapartofafull-timepositioninplacebutwhich weretemporarilyreplacedbyaPartialLoademployeewhichisMr.Balfoursaidthe normalrequirementofPartialLoademployees.Thereforethatevidenceisinconsistent withtheexistenceofafull-timeposition. 21 WiththeseassignmentsdeductedfromtheGrievor'steachingschedulethe remainingteachingtimewouldbeconsistentlybelow12hoursinaweekovertherelevant terms.Weconcludethatacreationofanon-goingFull-TimepositionintheMarketing ProgramoftheBusinessStudiesDivisionintheWinterTermof2003wasnotsupported bytheevidencewhichtheBoardhasconsideredandacceptedinitsdecision. Havingregardtotheevidenceandthesubmissionsforthepartiesandforallofthe foregoingreasons,weflndthattheUniondidnotestablishaviolationofArticle2.02of thecollectiveagreementbytheCollegeasalleged.Therefore,itisourawardthatthis grievanceisdismissed. Itisobviousfromtheevidencethatconsistentlyforanextendedperiodoftime, considerabieworkwasperformedbypartia!loadinstructors.In2003,whenthe grievancewasfiled,138teachinghourswereallocatedtopartialloadstaff.Eventhough sixfulltimeprofessorswerehiredfromthefiiingofthegrievanceto2005,thebodyof workassignedtopartialloadstaffdidnotdiminishsubstantially.In2005atotaiof117 hoursperweekwasassignedtopartialloadstaff;thatistheequivalentofeightfulltime positions. RickBurjaw,asapartialloadstaffmembertaughtthemaximumnumberofhours permitted-12hours,consistentlyfrom1993to2004.Hehadspecialexpertisefortwo courses,'NotforProfit'and'GlobalMarketing.'Hewastheonlyindividualemployedby thecollegeatthetimewhopossessedthosequalifications.Also,asnotedinthe majorityaward,Burjawtaughtseveralothercourses. AtonepointinJune2005,nonfulltimestaffaccountedfor50percentofthe teachingload.Between2001-2004otherpartialloadstafftaughtcoursesforthreeto eighthoursaweek,whichthegrievorwasbothqualifiedandavailabletoteach. .../2 Ineachsemester,sevenprofessorswereassignedco-ordinatorduties,foreight hours-meaning,theywerenotavailablefortheirregularteachingassignmentsduring .theeighthours.Thiswaslaterincreasedtoeightco-ordinators.Inadditiontofillingin fortheprofessorssoabsented,thegrievorandotherpartialloadstaffwerealso assignedtoreplacestaffwhowereabsentonmaternityandmedicalleave. ItisnotconsistentwiththeintentofArticle2ofthecollectiveagreementtohave partialloadstaffpermanentlyassignedworknormallyassignedtofulltimestaff. Whiletheindividuals'whoperformthisworkfromsemestertosemestermay change,thenumberofhoursallocatedtothisfunctiondoesnot.Inessence,theeight hoursandtheteachingresponsibilitiesassociatedwithitarepermanentlyvacatedand mustbefilledeverysemester.Thereisampleworktojustifythecreationofafulltime position. GivenwhatoccurredsurroundingMr.Burjawbeforeheleftthecollegeandwhat hastranspiredsince,itwouldhavetakenconsiderablylesseffortandlessfinancial resourcesforcollegeofficialstocreateajobpostingwhichwouldincorporatethe expertiserequiredtoteachthe'NotforProfit'and'GlobalMarketing'courses,thanitdid tocontinuouslyassignthecourseloadtopartialloadstaffoversomanysemesters simplytoavoidpostingafulltimepositionorpositions. Theremustbesomeintegritytothestaffassignmentprocess.Eighthoursof nonteachingresponsibilitiesforeightprofessorstranslatesintofourfullteaching positions.EvenintheMarketingProgramwheretwostaffwereassignedco-ordinating functionsthereare16teachinghourstobereplaced. InthisparticulararbitrationtheunionrequestedthattheBoardissuea Declarationthatthereisatleastonefulltimepositionavailableandtoorderthatthe positionbeassignedtoMr.Burjaw. However,Mr.Burjawhas,onhisownaccord,chosentoleavetheemployofthe college.InthissetofcircumstancesIwouldhaveissuedadeclarationthatonefulltime positiondoesexistandIwouldhavedirectedthecollegetopostthatposition. -2
