Briggs For the Hospital: Peter Hass For the Union: Peggy Smith Bev Weaver Ms. Dawna Greer filed a grievance (OPSEU File #2012-0444-0022) alleging violations of various provisions of the Collective Agreement. During a med/arb session recently held to discuss this matter, the parties agreed to the following: 1. The Clinical Laboratories will adopt the operational concept that should a full-time employee receive the benefit of a training opportunity in another lab that employee can continue to receive shifts in the other lab in order to maintain competency. 2. The understood corollary to the above is that a part-time employee, who is trained in two or more labs, then accepts a full- time role in one of the labs, they will not maintain shifts in the other discipline. 3. As a consequence of the foregoing, and specific to this grievance, the grievor will then be scheduled for any part-time shifts that become available in Cytology, provided no other scheduling conflicts arise. 4. It is agreed that there is no admission of liability or process error or fault on the part of the Hospital in regards to this matter and, in fact, any admission of such is expressly denied. 5. The grievor agrees that she has been properly represented by the Union throughout this process. 6. The grievor is to be paid three days pay at her current rate of pay forthwith. 7. Based on the foregoing, the grievance indicated above is resolved in full. 8. This agreement is without precedent or prejudice and cannot be relied on by either party in any other venue for any other matter whatsoever. I remain seized of this matter.
