INTERIMAWARD AlgonquinCollegeCommunityEmploymentServicesisbasedinthePembroke andPerthcampusesoftheCollege.Apredecessorprogramknownas"Job Connect"hadapositionofClericalAssistantwhichtheGrievoroccupied.TheJob ConnectprogramwasdiscontinuedandtheCollegewastherecipientofanew governmentprogramentitled"CommunityEmploymentServices".TheGrievor wastransferredtoPembroketotheResourceCentrelocatedinabusinessmall wherethegovernmentministrieswhooffertheseprogramsarelocated.Anew PositionDescriptionForm("PDF")wasdevelopedeffectiveAugust2010.The Grievorworksinthispositionasaclericalassistantbutclaimsinhergrievance thatshenowdoesresourceworkaswellandthisaspectofthepositionisnot reflectedinthePDF. TheCollegehasevaluatedthepositionatPembrokeandthegrievanceisdirected atthatevaluation.AtthetimethatImetwiththepartieson10May2013itwas apparenttomeandtoallpresentthatfurtherdiscussionswithmyassistanceand directionwererequiredbeforethemattercouldproceedtoarbitration.The purposeofthisInterimAwardistoprescribethatprocessandoutlinewhathasto bedone.Ontheagreementofallpartiesconcernedthematterwasadjourneduntil afurtherhearingsetfor18June2013inOttawaattheCollege.Atthehearingon the10thofMayitwasfurtheragreedasfollowsandisnowincorporatedinthis InterimAwardasordersoftheArbitrator. 1.Thehearingheldon10May2013istobecontinuedon18June2013.At thattimethepartieswillhavearevisedPDFandthearbitratorwillhear evidenceandargumentonwhateverFactorsundertheJobEvaluation Manualremainindispute. 2.Thepartieswereaskedtousethebalanceofthehearingdaytodiscusstheir differencesinthePDF.ByagreementofthePartiesandOrderofthe Arbitratorthepartiesaretohaveafurthermeetingon27May2013to resolveornarrowtheareasofdifferenceinthePDF.ThePDFdiscussions willbefinalizedatthattime. 2 3, On3June2013theUnionwillsubmittotheCollegeitswrittensubmission onanyfactorsthatremainindisputeandwhytheyoughttoberatedatthe leveltheUnionclaims.Thiswrittenprocesswillincludereferencetothe revisedPDFandtheUnionpositiononratingtheFactorsintheManual. 4.TheCollegeistoprovideitswrittenreplytotheUnionsubmissionsby10 June2013. 5.ThepartiesaretomaketheirsimultaneoussubmissionstotheArbitratoras providedforintheCollectiveAgreementbyl4June2013. 6.Ifthepartieshavenotreachedasettlementthenacontinuationhearingwill beheldon18June2013attheCollegeatalocationtobedetermined commencingateither9a.m.or1p.m.(tobeestablishedatalaterdate).
