Decision
[1] A request was made by Ms. Tardiel for a hearing arising from Minutes of
Settlement over which I remain seized.
[2] A hearing at Ms. Tardiel's request was scheduled for Wednesday, March 5,
2014 to address her concern. However, despite a request by the employer that
Ms. Tardiel provide particulars, or a statement, setting out the issue she wished
to have addressed at the hearing, none was provided. As a consequence, the
parties were unable to prepare for the hearing. This meant that, had Ms.
Tardiel's issue been raised only at the hearing, the parties would not have been
in any position to respond. The hearing would have served no useful purpose.
It was therefore cancelled.
[3] Before any future hearing is scheduled, the individual affected, in this case Ms.
Tardiel, must provide particulars of the issue they wish to raise, arising from
their Minutes of Settlement, so that the parties may prepare for the hearing of
that issue in advance of the hearing.
