Decision
[1] A policy grievance dated February 22, 2011 came before the Board. Following a number
of days of hearings, the Board issued its decision on December 10, 2013.
[2] A hearing was convened on N ovember 12, 2014 i n order to address implementation
issues. T he parties agreed to address these issues pursuant to article 22.16 of the
collective agreement.
[3] Having regard to all of the circumstances and the respective positions advanced by the
parties, the Board orders as follows:
1. The Employer shall comply with the December 10, 2013 decision of the Board
no later than February 2, 2015 or at such later date as mutually agreed upon by the
parties;
2. The December 10, 2013 decision shall apply to all of the institutions within
the Ministry of Community Safety and Correctional Services and the facilities
within the Ministry of Children and Youth Services;
3. There will be no retroactive remedial entitlement pursuant to the decision
prior to February 2, 2015.
[4] I remain seized of any disagreement arising out of the above orders.
