Bergeron, Counsel Sylvie Renault, Director, Human Resources APPEARANCES FOR THE UNION: Will Presley, Grievance Officer Linda Aho, President, OPSEU 668 Joanne Marshall, Steward A MEDIATION/ARBITRATION IN RELATION TO THIS MATTER WAS HELD AT SUDBURY, ONTARIO, ON MAY 1,2003. AWARD The Union filed the following policy grievance on 14 November, 2002: STATEMENT OF GRIEVANCE The Union grieves the Employer has violated the letter of Agreement entitled "Workload" with respect to what constitutes an active/inactive case. SETTLEMENT DESIRED That the Employer comply with the Collective Agreement. At the parties joint request, I acted as a mediator/arbitrator of the above grievance. I have incorporated the results of the mediation/arbitration into the following Arbitration Award. As the Arbitrator in this matter, I hereby order as follows: 1. Once a file is no longer deemed active as a result of the issuance of a supervisor consult note the worker will have 45 days to close the file. 2. If the file is not closed within the 45 day period the file will be returned to active status and the worker will be obliged to perform a home visit. 3. This order is in effect for the duration of the present Collective Agreement. I will remain seized of the implementation of this Award. DATED AT LONDON, ONTARIO, THIS 2nd DAY OF MAY, 2003. ~lil/!:!
