Briggs Vice-Chair FOR THE UNION Nick Mustari Ontario Public Service Employees Union Grievance Officers FOR THE EMPLOYER Gary Wylie Treasury Board Secretariat Centre for Employee Relations Employee Relations Advisor HEARING May 20, 2015 - 2 - Decision [1] The Employer and the Union at the St. Lawrence Valley Correctional and Treatment Centre agreed to participate in the Expedited Mediation-Arbitration process in accordance with the negotiated Protocol. Many of the grievances were settled through that process. However, a few grievances remained unresolved and therefore require a decision from this Board. The Protocol provides that decisions will be issued within a relatively short period of time after the actual mediation sessions and will be without reasons. Further, the decision is to be without prejudice and precedent. [2] Christopher Gregorie and Keith Berry are Correctional Officers. Each filed a grievance regarding accommodation and overtime opportunities/distribution. It was agreed by the parties that more facts were required in order for this Board to be in a position to make a determination. Accordingly, a process was agreed upon to that end. [3] It was agreed that the grievors will set out the facts at issue in each grievance and the Union will provide those facts to the Board and to the Employer no later than June 15th, 2015. The Employer representatives will respond in writing to the Union and to the Board no later than July 5th, 2015. Finally, the grievors will provide a response, if any, by July 19th, 2015. [4] It was further agreed that the Union and the Employer has the opportunity to provide written submissions and case law to the Board no later than July 26, 2015. [5] A short decision will be issued shortly thereafter in accordance with the usual Correctional med/arb protocol. Dated at Toronto, Ontario, this 27th day of May 2015. Felicity D. Briggs, Vice-Chair
