Watters Vice-Chair FOR THE UNION Mihad Fahmy Peggy Smith Barristers & Solicitors Counsel FOR THE EMPLOYER Cathy Phan Treasury Board Secretariat Legal Services Branch Counsel HEARING June 2, 2015 Decision [1] A Decision was issued in respect of this matter on January 5, 2012. [2] In the Decision, this Vice-Chair made several rulings to permit the parties to engage in meaningful discussions concerning the remedy appropriate in the circumstances of this case. Despite the passing of a considerable period of time and the expenditure of much effort, the parties, unfortunately, have not been able to resolve the issue of remedy which, as I understand, relates to the monetary amount payable to the grievor flowing from her employment as a Worker Advisor with the Office of the Worker Advisor in Windsor, Ontario. [3] The following Order is issued to ensure an expeditious resolution to this outstanding issue: i) The Employer will provide the grievor with its spread-sheet by June 30, 2015; ii) The grievor will respond to the Employer by July 31, 2015 and will identify any changes she considers appropriate; iii) If further changes are identified by the grievor, the Employer will respond to the grievor within two (2) weeks; iv) If the parties agree on the remedy, payment is to be made by the Employer to the grievor by September 14, 2015; and v) If the parties fail to reach agreement on the remedy, a telephone conference call between both counsel and this Vice-Chair will be scheduled for Monday, August 24, 2015.
