Hamilton - Counsel APPEARANCE FOR THE UNIONKevin Whitaker - Counsel A Hearing in this matter was heard in OAKVILLE on May 17, 1994 . A W A R D The Union grieves in this matter that the policy requiring the approval of English courses by the Program Faculty Dean contravenes the class definition of a professor and places professors in the class definition of an instructor. The Board requested and heard extensive opening statements describing both the factual and contractual context of this grievance. Having regard to these submissions and to the clear meaning and intent of the collective agreement (i.e. Article 2.01, Article 6.01, the class definitions for "Professor" and for "Instructor) we are compelled to find that a professor does not have final authority with respect to the selection of teaching materials, the determination of areas of studies, the designation of methods of evaluation or the choice of mechanisms of delivery of a course of study. The final authority in regard to these matters rests with the management of the college. Furthermore, the requirement to have these and all other aspects of course development approved by the management of the college does not constitute an improper reclassification of a professor. Accordingly, this grievance is dismissed.Dated in Toronto the 10th day of June, 1991. .
