Having regard to the agreement of the parties, as reflected in a Memorandum of
Settlement dated October 19, 1994, the Board of Arbitration hereby adopts and incorporates
the terms of the said Memorandum of Settlement attached hereto as Appendix "A" as the
award of this Board.

FANSHAWE COLLEGE OF APPLIED
ARTS AND TECHNOLOGY
("the College")

("the Union")
MEMORANDUM OF SETTLEMENT
WHERE AS the College has employed Dennis Jackson as a Technician in Math in the OBS/BTSD Program at
Uoodstock Campus ("the Program");
AND WEREAS the Union filed a Union Policy Grievance dated November 30, 1993 (OPSEU No. 94A449)
claiming that the position occupied by Dennis Jackson should be classified as a Partial Load Professor position
under the academic collective agreement ("the Grievance");
AND UHEREAS, upon investigation, the College has concluded that the work actually being performed by Dennis
Jackson in the Program was assigned and fell within the duties of a partial load professor;
NOTE THEREFORE THE PARTIES AGREE AS FOLLOWS:
1. The work which Dennis Jackson currently performs is work which falls within the duties of a partial load
professor.
2. Mr. Jackson's current appointment at the College will be converted from Technician to Partial Load Professor in
the Program.
3. The College agrees to a lump sum payment of $3,000 to Dennis Jackson less all statutory deductions applicable.
4. This settlement is confined to its own circumstances and is without prejudice to any future positions of the
parties under the collective agreement.
5. This settlement is to be made an order of the Board chaired by Michel Picher.
6. The Union hereby withdraws the Grievance.
7. This agreement effects a full and final settlement of any and all claims arising from the grievance.
