Decision
[1] Robert Samsone has filed a number of grievances, all dated November 13, 2014.
The Employer requested particulars of the grievances. By letter dated October 14,
2015 counsel for the Union provided some particulars.
[2] The Employer indicates that it requires further and better particulars. The Employer
may also bring preliminary objections to one or more of the grievances. The nature
of the objections the Employer brings will be dependent on whether additional
particulars are provided and, if provided, what those particulars state.
[3] Having regard to the foregoing, I make the following orders:
(i) On or before November 10, 2015, the Employer shall advise the Union in
writing of any further particulars it seeks in relation to these grievances. A
copy of this letter is to be filed with the Board.
(ii) On or before December 1, 2015, the Union shall provide all additional
particulars upon which it will seek to rely in advancing any of these
grievances. A copy of this letter is to be filed with the Board.
(iii) On or before December 22, 2015, the Employer shall identify all
preliminary objections which it intends to make arising from the particulars
provided by the Union in relation to these grievances. A copy of this letter
is to be filed with the Board.
(iv) A hearing shall be held on February 18, 2016 to hear full argument in
relation to any preliminary objections raised by the Employer.
