Decision
[1] The parties entered into a Memorandum of Settlement dated January 26, 2015,
under the terms of which I remained seized “to interpret and implement”.
[2] As a result of circumstances that were apparently unanticipated by both parties
after the Memorandum of Settlement was signed, issues have arisen respecting
the proper interpretation and implementation of the Settlement.
[3] Consequently, the parties scheduled a telephone conference with me for
appropriate direction.
[4] Having heard from the parties in this matter, I order that the terms of the
Memorandum of Settlement are to be held in abeyance pending further
discussions between the parties, to be scheduled (along with me) as soon as
possible after April 30, 2016.
[5] I continue to remain seized.
