INTERIM ARBITRAL AWARD This is a union policy grievance, dated April 14, 1992, in which it is alleged that the College did not give preference to full-time positions over partial load, part-time and sessional positions at its St. Thomas campus and that it is therefore in breach of various provisions of the collective agreement. At the opening of the hearing, counsel made submissions on various procedural or preliminary matters, including the scope of a summons served on an official of the College, the College's compliance with its contractual obligations to supply information to the union, the particulars provided by the union, and the raising of new allegations by the union. Following these submis- sions, the parties reached the following agreement to resolve the procedural questions: The parties agree to the following points for the purpose of the arbitration of the grievance dated April 14, 1992 (OPSEU file 92E311): a) The summons served on Mr. Tom Pickard is set aside. b) On or before February 26, 1993, the College will provide the union with the following data, for the period from May 1991 to May 1992, for each of the persons named in Schedule A to the summons and for every other session- al, part-time or partial load teacher working at the St. Thomas campus during that period: (i) name (ii) courses taught (iii) course number or name - 2 - (iv) program of course (v) hiring division (vi) hours of course (vii) hours taught by the teacher (viii) teacher's start and end date for the assignment to the course. c) On or before March 26, 1993, the union will provide the College with the particulars off'its claims in this grievance. d) If the College intends to argue that the year in question was "anomalous" and would not therefore justify a claim for a full-time position, the College accepts that it has the onus to present supporting evidence. e) The hearing will continue on May 28 and July 6, 1993.
