Decision
[1] The grievor, Deborah Beasley, is employed as an Inspector in the Industrial Sector
of the Ministry of Labour in the St. Catharines office. On February 6, 2015 she filed
a grievance alleging that she has been subjected to harassment by her supervisor,
Dennis Mondy.
[2] Specifically she points to two occasions when she felt he criticized and belittled her
in front of her colleagues. On October 29, 2014, Mr. Mondy lectured her about a
case before her colleagues. On January 15, 2015 he pointed her out regarding
limitation dates at a team meeting.
[3] Efforts to resolve the matter were unsuccessful and the parties agreed that we
would proceed in accordance with Article 22.16 of the Collective Agreement.
[4] Having heard the positions and submissions of the parties I have decided that this
grievance should be dismissed.
[5] The Employer denies the grievor’s allegation but even if I were to accept them as
true, I do not believe the Union has established a violation of the Collective
Agreement. I am satisfied that on both occasions the Employer was dealing with
performance issues and did not intend to harass the grievor
[6] For the above reasons, the grievance is dismissed.
