Tascona Nominee for the College Joe Herbert Nominee for the Union APPEARANCES: On behalf of the College: Peter Jarvis, Counsel On behalf of the Union: Susan Philpott Hearing held in Barrie on December 6, 1991. 2 AWARD The grievance alleges that the employer abused the usage of sessional appointments in contravention of Appendix III, paragraph 2. The admitted facts showed a pattern of partial load appointment followed by sessional appointment followed by partial load appointment. The inference of abuse which these admitted facts give rise to was quickly dispelled by the oral testimony adduced by the employer and by the analysis of the department's overall practises. Peter Watson was a very credible witness. The Union called no evidence to contradict his testimony. Although I can understand the grievor's disappointment, there has been no abuse and the grievance must be dismissed. DATED the 17th day of December, 1991.
