Hearing in this matter held in OAKVILLE, Ontario on June 9, 1998
AWARD
Whereas the parties have agreed to settle all matters in dispute arising from various
grievances and claims to assignments in the Machine Shop Labour course in Continuing
Education and in Skills and Apprenticeship Retraining, the board now orders as follows:
1. On August 31, 1998, Wm. Mclntosh, John Sibson and Gunnar Ghosh shall be assigned
full-time assignments in Skills and Apprenticeship Retraining under the collective
agreement. John Sibson and Gunnar Ghosh shall be recalled on August 31, 1998 for that
purpose.
2. To facilitate employment stability, fourteen thousand dollars ($14,000) shall be made
available for JESRF to cover employer's portion of fringe benefit and pension costs for
two persons for the period August 31, 1998 to April 13, 1999.
3. With reference to the Early Leave Plan, two positions shall be counted effective August
31, 1998 as new complement positions.
4. Effective July 18, 1998, teaching assignments and teaching hours in Continuing Education
will not thereafter form part of any teaching assignment to or teaching hours of full-time
academic staff In this connection, any local agreements and arrangements, including that
dated September 22, 1994, will be null and void and have no further application.
5. Grievances arising directly or indirectly from such assignments referred to in paragraph 4
above, including Mr. Ghosh's grievances of October 24 and November 3, 1997 and
February 27, 1998 shall be withdrawn from arbitration and settled on the basis set out
above.
6. Mr. Ghosh's seniority date will remain unchanged.

7. Mr. Ghosh can continue his benefits as a "layoff" employee if he funds the premiums
himself until August 31, 1998.
8. The Board shall remain seized for enforcement of this settlement until September 21,
1998.
