Eliott (Counsel for the Union) Sara Manoll A hearing in this matter was held in Kingston, Ontario, on February 21, 1997 AWARD This arbitration proceeding arises from the grievance of Nola Kendall, who challenges the way in which the collective agreement's layoff and redeployment procedures were applied to her in 1996. The matter came on for hearing before this Board of Arbitration on Friday, February 21, 1997. The parties were agreed that the Board was properly constituted under the terms of the collective agreement, and that the Board had jurisdiction to hear and determine the matters in dispute between them. After opening statements, however, the parties entered into settlement discussions, and were eventually able to resolve all of the matters in dispute between them. The terms of their settlement need not be set out here. It suffices to say that the parties have completely resolved their dispute, and that (subject to compliance with the terms of settlement) Ms. Kendall's grievance is withdrawn and this arbitration proceeding is terminated. Finally, in accordance with the further agreement of the parties, this Board of Arbitration will remain seized with the matter in case there are any residual difficulties in implementing the terms of settlement.
