Thorup Counsel Winkler, Filion & Wakely Barristers & Solicitors Hearing: July 20, 1989 A hearing in this matter was scheduled in Toronto for July 20, 1989. Prior to convening the hearing on July 20th, the Board was advised that the parties had reached a settlement in accordance with the terms set out in Appendix "A" herein. This settlement shall have the same force and effect as if it were an award of the Board. Daughart~ 2 APPENDI~ "A" Minutes of Settlement Between: Workers' Compensation Board (The "Employer") - and - C.U.P.E., Loc. 1750 (The "Union") · ~:~ - and - Rochelle Spiegel (The "Employee") In full and final settlement of the Employee's grievance dated July 13, 1988 and the issues which could have been raised, the Employer, the Union and the Employee hereby agree as follows: 1. Immediately after the expiry of three (3) months and are (1) day following the closing date of the current posting for the position of Employer Service Representative (Closing date: June 15/89), the Employer will post another position for Employer Service Representative for which the Employee and any other interested employee may compete in accordance with and subject to the provisions of Article 5. 2. The instant grievance is withdrawn without prejudice to the Employee's right to grieve following the decision in the upcoming posting referred to abo'vel 3 It is agreed that in the upcoming posting and interview process (and in any other or future grievance) this grievance and the matters arising during the June/July 1988 posting/interview process shall not be raised or considered. 4. The Employer confirms that its representatives for the · ..'.C." -~':" ..~ upcoming competition interviews will not be advised of ·.,, !~.. ~ '~. :~ the details of this settlement and such representatives will not be the same representativ~es who conducted the June/July 1988 interviews. ;,'" 5. These Minutes of Settlement are entered into on a without prejudice basis and shall not be considered as any form of admission.
