ORDER
In the matter of an arbitration between the Ministry of
Correctional Services and Mr. A. S. Hurge, Probation Officer 2
Probation and Parole, Ottawa East, GSB 1193/99
Without prejudice and without reference to any future and/or
similar case, the parties agree to the following conditions of
settlement:
1. A review and assessment of the workload audit and
performance appraisal of Mr. A. S. Hurge for the
1987-88 period will be undertaken by a third party
agreed upon by the parties. The third party will
discuss the workload audit and perCormance appraisal
with Mr.~ Hurge and 'his Area~Manager, Mr. P. Sirrs.
The third party will prepare a report and
recommendations embodying his assessment of the
workload audit and performance appraisal.
2. Mr. Sirrs will give Cull consideration to the report
and any recommendations of the third party and will
reconsider in good Caith the 1987-88 performance
appraisal in light of the report and recommendations.
3. The parties will proceed with the 1988-89 workload
audit through the appropriate process of discussions
between Mr. Sifts and Mr. Hurge. The parties
recognize that full discussion is essential to the
~,proper completion of the. workload audit.
4. Mr. Sirrs agrees that Mr. Hurge will be provided with
a copy of any documentation or correspondence which
is received by or is prepared by Mr. Sirrs and which
to Mr. Sirrs' knowled§e forms part of Mr. Hurge's
corporate personnel ~ile. This term will be
effective as of the date this memorandum is ratified
by the parties.
5. The letter dated November 21'; 1988 from Mr. Sifts to
Mr. Hurge regarding the banquet at the Radisson Hotel
will be amended to include the following sentence at
the end of the third paragraph on page 1: "I
acknowledge that you were properly in attendance at
the banquet."

6. Mr. Hurge and the Union agree to withdraw the
above-noted Grievances dated November 2, 1988 and
November 10, 1988.
7. This agreement will be made an order of the Grievance
Settlement Board.
