ORDER
The grievor applied for a posted position' as a Systems Officer 3
(competition number SS95/89) and was unsuccessful. He grieved that he
had been denied the position unfairly.
At our hearing, the parties, together with the successful applicant,
reached a settlement, which we were asked to record as an order of the
Board. It is as follows:
1. The Ministry agrees to conduct a rerun of competition
SS95/89 for the position of Systems Officer 3 in the
Systems Development Branch of the Ministry on the
following terms:
a. the selection panel shall be composed of four persons
as follows:
i. Jan Ancevich, or, if she is not available, then
the next senior person in the Employment
Equity Branch;
ii. Jean Linton, or, if she is not available, John
Van Vliet;
iii. Grace Wong, or, if she is not available,
Lloyd Kishino;
iv. Vera Anklesaria;
b. the only persons to be interviewed will be Alfred
Cheung and the grievor;
c. Mr. Cheung and the grievor's qualifications shall be
assesed as of June 5, 1989.
2. This settlement is without prejudice or precedent to either
party with respect to any other grievance or matter.
3. The grievor and the Union hereby agree to withdraw this
grievance upon fulfilment of the terms of this settlement.
4. This settlement shall be made an order of the Board.
The settlement is signed on behalf of the Ministry, the Union, by the
grievor and by Mr. Cheung.
We order the parties to implement their settlement.
It was also agreed by the parties that the Board would remain seized
to deal with any problem in implementing the settlement.
