Toole, Member ~43~ORANDU~ OF SETTLEMENT BETWEEN' OPSEU (Mr2 Johnson)..~ and .~ MINISTRY OF THE ENVIRONMENT The following terms reflect a. final and binding settlement for the grievance of Mr. Johnson, dated February 14, 1991: 1. That the Minist~ has developed a job specification for the grievor that has been classified at the Environmental Officer 5 level. 2. The position'specification includes, but is not restricted to duties such as: - ground and air surveillance; - critical analysis of reports; - developing standards and guidelines for surveillance evidence in court; - preparing background for Environmental programs; - working with Legal Services Branch in the prosecution of Environmental offenders. 3. A work plan/training program has been developed for . Mr. Johnson with his supervisor. This plan includes a six {6) week training program (spread over a period of time} and other courses such as investigation techniques and gathering/presenting evidence. During that period while the work plan is in place, Mr. Johnson will be classified as an Environmental Officer 4 earning $968.97/week at an underfill level for an Environmental Officer 5. 4. Mr. Johnson will be classified at the Environmental Officer 4 level back to Febr%lary 14, 1991. A workplan review by his supervisor commencing June 1992 and every three months thereafter will be conducted to appraise Mr. Johnson's performance. If the supervisor feels that - 2 - Mr. Johnson satisfactorily meets the E05 level position specification details, the E04 underfill status will be removed. However, before February 14, 1993 the Ministry will conduct a final appraisal of Mr. Johnson and if satisfactory remove the underfill status of Mr. Johnson. 5. At such time as Mr. Johnson has achieved the full working level of an Environmental Officer 5, he will be reclassified to that level under the normal pronkotiona~ provisions as laid out in the Collective Agreement. The ~rievor withdraws his grievance dated February 14, 1991 and accepts the current classification of Environmental Officer 4 (Underfill) as being the appropriate classification. Once the underfill has been removed, the grievor accepts that level of E05 as the appropriate classification. 7. The settlement ~s without prejudice/precedent to either party. The parties agree that this Memorandum of Settlement shall be~made an Order of the Grievance Settlement Board. Dated this //~- day of September 1992.
