Craig EMPLOYER Senior Staff Relations Consultant Ministry of Education HEARING May 1, 1992 This a classification grievance under the Expedited Arbitration procedure found in Article 27.18 of the current Collective Agreement. In so far as Article 27.18.7 calls for the single arbitrator to issue a "brief written decision" and because Article 27.18.8 indicates that this decision will have no precedential value, I have decided to depart from the usual writing style of'these awards and to restrict the recitation of the facts and argument and instead to focus on the reasons for the decision itself. The Grievor is a Television Technician working with the Ernest C. Drury School. He is and has always been Communications Technician II. He seeks reclassification as a Communication Technician II!. Neither party wants a Berry order even though both parties admit that the Grievor's classification within the Communications Technical group is atypical. The entire Communications Technical series is attached. The first distinguishing characteristic between the Communications Technician Il and Communications Technical I!1 is the degree of complexity involved in the machinery which the employee operates. The terminology in the Class Standards show the following gradient of complexity: Communications Technician I "technical work" 2 Communications Technician il . "more specialized technical work" Communications Technician III . "highly technical communications work". The evidence discloses, that the Grievor deals with the following types of technology; televisions, video cassette recorders, overhead pmiectors, movie proiectors, video cameras, public address systems and T.V. decoders. All of these machines are what could be called "consumer electronics". It would not seem logical to infer that work on these types of machines was contemplated by the drafters of the Class Series to be typical of "highly technical communications work". Rather the Communications Technician standard of "more specialized technical work" seems to be the better fit. In terms of supervision, the evidence is clear that the Grievor does not supervise anyone. The Communications Technician I!1 standard contemplates that these employees "supervise radio communications laboratories" and have "tull responsibility for the effective direction, supervision and administration of their own radio laboratory'. As well they "provide technical instruction and advice to District Technicians", which is another term for a Communications Technician I. For the Communications Technician ii on the other hand, the element of supervision over other technical personnel is not as pronounced, In other words one can be a Communications " ONTARIO .. Merritt, Me~fl:~er MEMORANDUM OF SE'ITI.,EMENT between THE ONTARIO PUBLIC SERVICE EMPLOYEES UNION (on behalf of the Grlevors named in Appendix I herein) and ' THE CROWN IN RIGHT OF ONTARIO - (Ministry of the Solicitor General) In the matter of the grievance of Baird et al, G.S.B. File Nos. 1644/91 and 1822/91. The parries hereto agree to the following as full and final settlement'of all matters arising in the above- noted grievances: (1) The Employer agrees to compensate each Grievor for the period between July 30, 1987 and December 31, 1989 in which he or she was classified in the Security Officer Class series based on the rate to which he or she was entitled on January 1, 1990, l~ss be applicable category revision for the General Services Category up to and including the lanua~y 1, 1990 revisions. (2) The Employer shall pay interest on the principal owing in paragraph'l up to and including th~ dates on which payments were made pursuant to the Memorandum of Settlement which is auached as Appendix l.to this settlement, Interest shall be calculated in the fashion set out in paragraph 3 of the Memorandum of Settlement in Appendix I. No further intexv, st shall accrue after these dates. These dates am the following: (a) For regular, non-overtime hours worked by each Orievor while in the Security Officer Class series between July 30, 1987 and December 31, 1989, no interest shall_ accrue after lune 20, 1991. For over~e hours worked by each C~rievor while in th~ Security Officer Class series between luly 30, 1987 and December 31, 1989 no interest shall accrue after October 2, (3) The above sum shall be paid in a lump sum less legally required deductions. Payment to any Grievor pu~uant to paragraphs I and 2 and in accordance w/th the process set out in paragraph 3 will be subject to ratification of this settlement by all individual Grievors, a list of which is attached to this Settlement as Appendix ti, and ~he withdrawal of all outstanding grievances' relating to retroactive salary adjustments for Security Officers prior to January 1, 1990. (4) This Settlement is without prejudice to any further position the pakies may r.._ke in any o~her matter of procce~g between .the parties. This S~ltlcment shall not be raised or ~lied upon in any further or other disputes.
