MEMORANDUM OF SETTLEMENT
IN THE MATTER OF
Ontario Public Service Employees Union
(Robert Gordon)

THE CROWN-AN~ RIGHT OF ONTARIO

Without prejudice and without precedent, the parties agree to the following
in settlement of the three grievances, dated OctOber 23, 1991 - overtime grievance, April 30,
1991 - discrimination and harassment grievance, and April 30, 1991 - shift exchange
grievance:
1. Dennis Philipson will meet with Robert Gordon during Mr. Gordon's
regularly scheduled work time and within one month of the signing of this
Settlement in order to discuss Mr. Gordon's concerns and the incidents in
which Mr. Gordon feels he has been harassed and discriminated;
2. Mr. Gordon will, if he feels he is being further harassed or discriminated
against by any employee, be able to approach either or both Mr. Kerlew and
Mr. Philipson in order to try and have the matter rectified; Mr. Gordon shall
be able to exercise such added privilege at any time within a one year period
for Mr. Kerlew; Mr. Gordon will be able to exercise such added privilege and
discuss his concerns with Mr~ Philipson up until December 31, 1992; it is
understood that Mr. Gordon will first approach Mr. Kerlew;

3. The Ministry will pay to have Mr. Gordon attend a stress management course,
to which the parties can agree, within six months and during Mr. Gordon's
regularly scheduled work shift;
4. Mr. Gordon will be paid time and a half for the half hour worked overtime
on January 23, 1990 at the rate of pay at the time the overtime was worked;
5. Mr. Gordon will be credited w/th a twelve hour sick day credit;
6. Either party may request that the Grievance Settlement Board put the terms
of the Settlement into an award of the Board; and
7. The Union and the Grievor-agree to withdraw the above three grievances.
