Abramsky Appearances: For the Employer: William LeMay Counsel For the Union: Hilary Cook Counsel Hearing: January 29, 2014 in Toronto, Ontario This case concerns the discharge of a Special Constable, Mr, Amedeo Popescu. Mr. Popescu has been employed by the Employer, the Toronto Community Housing Corporation ("TCHC"), for approximately 18 years. His disciplinary record consisted of a five (5) day suspension. He was discharged as a result of allegedly unprofessional conduct relating to communications between himself an a member of the Toronto Police Service. This discharge was referred to arbitration before me on October 3rd, 2013, and continued on January 291h, 2014. Having heard the representations of the parties, and having considered the documentation filed by the parties, I hereby Order as follows: 1. TCHC is hereby directed to reinstate the grievor to his employment, subject to the remainder of this Award, subject to such terms as the parties may negotiate between them, and subject to the successful reinstatement of his Constable Status. 2. TCHC is further directed to facilitate the grievor's application to reinstate his Special Constable status in good faith. More specifically, TCHC is directed not to make any representation to Toronto Police Service that would bring the grievor's character, reputation, or suitability for Special Constable status into question.
