DATED at Toronto, this 17th day of March, 1997. /  J.~ , Vice-Chairperson GSB File Nos. 0239/92, 1254/92, 2004/94, 1269/94 and 2351192 IN TI-IE MATTER OF A GRIEVANCE BETWEEN: THE ONTARIO PUBLIC SERVICE EMPLOYEES' Lqx.rION, ("the Union") -and- THE CROWN IN RIGHT OF ONTARIO (Ministry of the Solicitor General and Correctional Services) ("the Employer") NIGEL MACKEY ("the C-rievor") MEMORANDUM OF SETTLEMENT The parties agree to a full and final settlement of Se above-noted grievm~ces wilhoux admissions, prejudice and precedent to any future and/or similar matter on the following terms: 1. Management at the Toronto Jail ("Management") agrees that sick credits used in the calendar year of 1992 will not be used for the purposes of attendance review. 2. Management and the Union regret the personality conffict between the Orievor and Ms. McCabe. -2- 3. Management will continue to provide a workplace free of discrhuination and harassmen',. pursuant to Art'i.cle A of ~,.e Collective Agreement. 4. Management will continue to take reasonable steps to provide a safe working emdrorznent' pursuant to ,~,'ficle 18 of the Collective Agreement. 5. Management agrees, wSth reasonable notice, to grant the Crrievor access to his personnel file and a reasonable time in which to review the contents. 6. Subject to verification by the Union of the GSB File numbers listed at the outset, the parties affix their respective signatures below. 7. These Minutes of Settlement shall issue as a consent award of the Grievance Settlement Board. DATED this-30th day of October, 1995.
