CONSENT AWARD
The parties have agreed to resolve Grievances #2015-0469-0002 and 2015-0469-
0001 as follows:
This Award pertains to three Collective Agreements:
- The Nurses' Collective Agreement, which applies to Full -Time and Part -Time
employees;
- The Service (Full -Time) Collective Agreement, and;
- The Service (Part -Time) Collective Agreement.
For the purposes of the Nurses' Collective Agreement, four consecutive days off for
Christmas is defined as December 24-25 or December 25-26 plus two contiguous
days off. For the purposes of News Years, four consecutive days off is defined as
December 31 and January 1 plus two contiguous days off.
None of the three Collective Agreements provide a guarantee of work on either
Christmas or New Years.
The Nurses' Collective Agreement provides for the scheduling of time off at
Christmas or New Years on an alternating basis for full-time nursing employees
only.
The Service (Full -Time) Collective Agreement provides for the scheduling of time off
at Christmas or New Years on an alternating basis for full-time service employees.
The Service (Part -Time) Collective Agreement provides for the scheduling of time
off at Christmas or New Years on an alternating basis for part-time service
employees.
Notwithstanding the regular scheduling of employees, the scheduling of employees
at Christmas and/or New Years has to be done on an alternating basis in
accordance with the applicable provision of each Collective Agreement.
An employee who wishes to work both holidays will make a request of the Employer
and if the request can be accommodated by the Employer, the consent of the Union
is required.
For greater clarity, none of the above provisions apply to casual employees.
I remain seized.
DATED IN CORNWALL ON AUGUST 29, 2016.
