D E CIS ION
On April 30, 1993, we (granted the union a contested I
adjournment of the hearing of these four grievances on certain
strict terms, to August 25, 1993, peremptory to the union
i
On August 25t~ neither grievor was present, but we were
advised that Mr Innes had returned to Canada from his foreign
travels and that the parties had settled his grievances They
asked that his grievances be adjourned pending the signing of
Minutes of Settle~ent, and we so ordered
With respect to Mr McKague, we heard last time that he was
planning to stay in Israel until about the end of May, then travel
in Turkey, Syria, Jordan and Egypt. Union counsel attempted to
contact him at the Israel address and fax number Mr McKague had
provided, but got no response Another letter sent to another

address was returned Mr Innes had' been in contact with Mr
McKague and knew that he was now travelling in India, with no
forecasted return date Union counsel again requested an
adjournment 'on Mr McKague's behalf because it may be that Mr
McKague still doesn't know about his scheduled hearing
We declined to adjourn Mr McKague's hearing because all of
(
the evidence we have received to date sugges~s that Mr McKague is
not very interested in pursuing his grievances; he has been given
a chance; and we don't think the employer should be put to further

legal expense and trouble in the matter Having denied the union
request for the adjournment, the union offered no evidence and we

dismissed Mr McKague's grievances
