BOARD ORDER
Attached is the Memorandum of Settlement which the parties
agreed would be made an Order of the Board.
DATED at Toronto, this 19th day of December, 1996.

At the request of the parties, the Board hereby issues the following order'
1 This agreement is made without precedent and without prejudice to the positions to
either party
2. The grievor shall be re-instated to the classification of Counsellor 'II, Residential Life,
effective March 1, 1995
3 The grievor shall be paid the salary of a Counsellor II, Residential Life effective
March 1, 1995, subjecUo paragraph 5 and statutory deductions required by law
4 The employer shall remit the appropriate and required Pension contributions based
on the grievor's reinstatement to the classification of Counsellor II, Residential Life,
effective March 1, 1995 '
5 The employer shall deduct from the retroactive salary payments owing to the grievor
pursuant to paragraph 3 and remit the appropriate and required employee share of
the Pension contributions.
6 For clarification, it is understood that the grievor's severance entitlements shall be
calculated based on the Counsellor II, Residential Life salary
7 The retroactive share of the salary payments under paragraph 3 and 5 shall be paid
in the month of January, 1997
8 It is understood that the grievor will be retiring under the Factor 80 program effective
March 31, 1997
9 Notwithstanding, the grievor's reinstatement to the classification of Counsellor II,
Residential Life it is understood that between the date of the signing of this
memorandum and the grievor's retirement, he shall continue to perform the duties of
Hospital Attendant I
10 The parties agree that the Minutes of Settlement be made an order of the Board
11 Vice-Chair B Fisher remains seized of the Minutes of Settlement.
12 The grievor and the Union withdraw the grievance
