DECISION
Files 0833/93 and 2394/93 are individual ,grievances filed
py the grievor Mr~ Mark Ladha. This hearing was conveneq. to
decide how these two individual grievances and another group
of ~ob competition grievances (including one by the grievor
Ladha) referred to as Anderson et al would be heard
~
Notice of the hearing was provided to the inc~mbents and
the grievors in the job ~ompetition grieva~ces. Five of the
incumbents, Ms. Marsha Fouks, Mr Darryl Hayashi, Mr. Leo
Herskovits, ,Mr. .Mark Langden. and Mr. Caspar V~rre appeared in
person. Incumbent Mr. Robert Francella appeared with his
counsel, 'Mr. Walter J. Wysocky, Barristers & Splicitor.

Following discussions among all of those present the
fOllowing agreement w~s reach~d: ,
( 1) The Board consisting of myself as Vic~-~hair person
will hear Mr. Ladha's individual grievances.
(2) At the conclusion of the hearing of the Ladha
individual grievances, the Board will issue its award.
-
(3) The Board will be entitled to apply the findings in
the Ladha individual grievances to the Anderson et al job
,
competition grievances.
(4) In the jOb competition grievances, the incumbents '-
will be entitled to argue the relevance, if any, of the
Board's findings in the Ladha individual grievances

As 'a result of the foregoing agreement, the incumbents
agreed that they would not be attending the hearing relating
to the Ladha individual grievances /-
The foregoing is included ina Board dec~sion at the
joint request of the employer, union and the incumbents.
The Ladha individual grievances will heard on october 27;
November 9, 21, 22; December 1, 15 of 1995.
