Introduction
In our interim order dated May 5, 1994, the Board dealt with a number C?f
preliminary matters in dispute. The case was then scheduled to proceed on
November 3rd and 4th, 1994 in Thunder Bay Shortly before this scheduled
continuation date a new union counsel was appointed and, on the consent of
the parties, these continuation dates were adjourned In the meantime, the
Board had received some correspondence from counsel for both parties with
respect to ,some other preliminary matters which had arisen On November
3, 1994, a conference call was convened between the Board and both union
and employer counsel After hearing the submissions of the parties, the
Board makes the following further orders:
1 The employer is directed to produce, and to disclose to union counsel, all

documents and other materials gathered as part of the grievor's WDHP
\
complaint and the subsequent investigation of that complaint. Introduction
of any of these materials before the Board, however, will be subject to the
usual admissibility rules
\
2. In our interim order the employer was directed to advise the following
persons of these proceedings and of the fact that they may have the right to
participate in these proceedings either alone or represented by counsel

Wayne Johnson
Robert Lisenchuk
Scott McCallum
The employer is now directed to provide each of these persons with a copy
of this interim order and to advise these individuals that they may have a

right to apply for and obtain copies of the particulars being prepared and
exchanged in this case The employer if further directed to advise these
individuals that any submissions with respect to any participation rights
they may have, including any rights they may have to particulars, will be
heard when the Board' reconvenes in Thunder Bay on November 1 7, 1 994 at
1 0.30 a m. and that if they wish to participate, and/or to obtain copies of
these particulars, that they should attend at the hearing at that time
,
prepared to make submissions in support of any such claims.
