Minutes of Settlement and Consent Order
,
Whereas the Union filed two (2) Job competition grievances (the Grievances) on behalf of the
, Grievor for the positions of Probation Officer 2,
And whereas the ~ucessfu1 candidates in the diSputed competitions were unclassified Proba-
tion Officer 2s and the grievor is Q Correctional Officer 2 "'With 4 yeQ1'S sc:niority and had rclntcd
experience as a Probation Officer 1;
And whereas the parties wish to resolve t..'le issues in dispute without a hearing and without
prejudice and precedent to any similar or future proceedings between them,
Therefore the parties agree as follows in full and final settlement of the Grievances:

1. The :Ministry' shall place the GrievoJ' in the permanent position of Prcba~ 0Hial'r 1 at the Dan-
forth Avenue Probation and Parole Office on or before January ~i 1995. There will be no
reimbursement for any relocation expenses associated with this placement but the Ministry's
standard. practice with respect to wages and ~t for acting in the position shall apply. The
:Ministry ha& assured the Union that no employees on the surplus or lateral transfer lists have a
claim to this position and tbat Ute pl~cenlent of the Grlevor $lulll uvL,dlsp~ce any other employee
2. These :Minutes of Settlement and Consent Order are in full and final settlement of the Grievances
and are without prejudice and precedent to any future and/ or similar ma_tters between the par~
ties. They are not an admission of wrongdoIng nor of a violation of the Collective Agreement by
any party
3. The Grievor acknowledges that as of the date of these Minutes of, Settlement, he has no other ac-
tions against the ~StIYI aside from the Gne.vances ariSing out of the job competitions. The
Grievor agrees that he shall not commence any actions against the :Ministry, or the Union, for
events arising out of the competitions, the Grievances Of' thp ~E'ttlPD:\ppt of thp. Gri~vanc~.s, s..a-ve
and except proceedL"lgs to enforce these Minutes of Settlement and Consent Order.

4. The parties 14-! shall file this settlement with the Grievance Settle:a,.ent Board and hereby re-
quest that the Board issue a decision and Consent Order giving effect to this agteement as a final
