MEMORANDUM OF SETILEMENT
Gnevance Settlement Board # 0070/94
In the matter of the grievance Between.
OPSEU (Uruon)
on behalf of
Elizabeth Eyre
(Grievor)
- and -
The Crown m Right of Ontario
as represented by
The Ministry of Community and Social Services
(Employer)
The partIes agree to an order of the Gnevance Settlement Board as follows
1 The gnevor is reinstated, subject to clause 5, effective January 25, 1994
2 The gnevor shall submit to a mandatory medical examination as set out in Article
52 9 of the Collective Agreement. The physician shall be mutually agreed upon
by the parties and shall be supplIed WIth the medIcal reports forming Exhibit III
in this hearing
3 The resultmg medical report from the aforementIOned exammatIon shall be
submitted in support of an application for Long Term Income Protection (L TIP)
on the basis of workplace stress disorder
4 In the event that the apphcatIon for LTIP is successful,
(i) The grievor's corporate personnel fIle will not contain any reference to the
reason for the granting of LTIP benefits, and
(ii) The period from January 25, 1994 to July 25, 1994 would be conSIdered
Short Term Sick Leave, and
(ui) Effective July 26, 1994 the grievor would be considered to be on a leave
.- of absence without pay, and
(iv) If at any time after bemg approved for LTIP Ms Eyre is declared fit for
work by an mdependent physician selected by management, the partIes
mutually agree that Ms Eyre will not return to work WIth the Mmistry of
Community and SOCIal Services and therefore that Ms Eyre will not be
eligible under ArtIcle 24 for remstatement with the Mmistry of Community
and Social Services but will be eligible for assignment to another Mmistry
under Article 24
5 In the event that the LTIP applicatIOn IS unsuccessful,
(i) The parties may return to this panel of the Board to pursue thIS gnevance,
and
(Ii) This panel remam seized of this grievance, and
(hi) The grievor's remstatement is vOIded
6 There shall be no contact between the parties except through union representatIves
of legal counsel
7 Ms Eyre will withdraw her grievance upon successful apphcatlon for L TIP
