MEMORANDUM OF SETTLEMENT
IN THE MATTER OF A GRIEVANCE
BEFORE THE
GRIEVANCE SETTLEMENT BOARD
BETWEEN
ONTARIO PUBLIC SERVICE EMPLOYEES UNION
(Lloyd McDougall Jr.)
AND
THE CROWN IN RIGHT OF ONTARIO
METROPOLITAN TORONTO HOUSING AUTHORITY

Without prejudice or precedent, the parties agree to resolve the
above-captioned grievance dated May 19, 1992 on the following
terms
1 The Employer agrees that the Grievor is improperly classified
as Services Supervisor 2 (Atypical)
2 The Employer shall find or create a new class standard which
accurately reflects the duties and responsibilities of the
Grievor within ninety (90) days from the date of receipt of
the Union's execution of the Memorandum of Settlement
3 The Employer agrees that upon the creation of the new
classification referred to in paragraph two (2) , and upon
negotiations as to the appropriate wage rate as set out in the
collective agreement, the Grievor shall be reclassified in
that new classification and shall be reimbursed for any lost
wage or benefit enti'Llement resulting from the improper
classification
t.fz The Employer shall calculate the payment of any interest on
the retroactive wages referred to in paragraph three ( 3 ) in
accordance with the formula set out in Hallowel House Limited
(1980) OLRB Rep Jan 35)
S~ Upon implementation of the terms of this settlement, the
Grievor and the Union shall withdraw the grievance

shall remain seized of this matter in the event that any
differences arise from the lmplementation or failure to
implement the terms of this settlement
