MEMORANDUM OF SETTLEMENT
BETWEEN
PAUL DOPP
(the "Grievor")
AND
ONTARIO PUBLIC SERVICE EMPLOYEES UNION
(the "Union")
AND
THE CROWN IN RIGHT OF ONTARIO
as represented by
the Ministry of the Attorney General
(the "Employer")
Whereas the Grievor filed a grievance that was referred to arbitration under GSB File No.
234/94 The parties agree without precedent or prejudice to the following:
1 The Employer will pay to the Gnevor the equivalent of 18 months of his salary less
statutory deductions, calculated on the basis of his most current wage rate as of October
5, 1993, representing back pay from October 5, 1993, the date upon wmch he was
suspended without pay, until March 24, 1995
.
2. The Employer will pay to the Grievor interest on the amount m paragraph 1 on the
basis of the Ontario Labour Relations Board decISIon in the Hallowell House case.
3 The Employer will pay to the Grievor a lump sum equal to 12 months of his salary,
calculated on the basIS of his most current wage rate as of October 5, 1993
4 Upon receIpts provIded by the GrIevor, the Employer wIll pay to the Grievor $328 56
representmg the cost of preSCriptIOn drugs incurred by the Grievor during the period of
October 5, 1993 to March 24, 1995
5 The Employer Will provide to the Grievor wntten confirmatIOn that all outstandmg
vacation, overtime and compensatory entItlements have been paid.
6 The Gnevor will reSIgn from his employment With the OntarIO PublIc Service and
prOVIde the Employer with a letter of reSIgnatIOn. The Employer Will remove from all
of the Grievor's personnel files all documents pertammg to hIS employment from July
12, 1993 to the present.
7 If contacted m the future, the Employer agrees to provIde the Gnevor with a letter of
record of employment as set out m Schedule "A" to tills Memorandum.
8 The Gnevor acknowledges that he has receIved legal advIce from Umon counsel wIth
respect to thIS agreement and has been fully mformed and understands the effect of
executmg thIS agreement.
9 The Gnevor acknowledges that he fully understands the terms of thIS agreement and
that the benefits set out in paragraphs 1 - 5 above are the sole consIderatIOn for his
resignation and the Withdrawal of thIs grievance.
10 In consIderatIOn of the provISIOns of paragraphs 1 - 5 above, the Umon and the Gnevor
agree to withdraw thIs gnevance. In further consideration of the prOVIsions of
paragraphs 1 - 5 above, the Umon and the Gnevor release and forever dIscharge the
Employer, its employees, agents, directors and servants of and from all actions, causes
of actIOn, claims and demands of every nature and kind arismg out of or as a result of
ills employment, mcluclmg, but not limIted to, all clarrns arIsing under the Human
RIghts Code and the Em{>lovment Standards Act. and mcluclmg but not lImIted to any
mjury to his reputation or any mental or emotional dIstress suffered by the Gnevor
11 The parties agree that this Memorandum of Settlement will be made an Order of the
Gnevance Settlement Board.
12. The parties agree that this document may be executed by facsImile and that signatures
received by facsunile are both acceptable and bmding.
