DECISION
Wlth respect to the two grievances before me, the parties entered
into discussions during the hearing and reached the following
resolution
MEMORANDUM OF SETTLEMENT
BETWEEN
FRANK COLLINS

MINISTRY OF TRANSPORTATION
(the employer)
- AND -
OPSEU
(the union)
In the matter of the Bridger grievance dated April 19, 1995 and the
Collins grievance dated April 12, 1995 concerning the job
competition ER-40-22, the parties agree to the following as full
and final settlement without prejudice or precedence
1 The grievors, Bridger and Collins, and the Union agree to
withdraw the aforementioned grievances
2 The Employer agrees to offer the grievors an interview the next
time interviews are held in an Occupational Health and Safety
Advisor compet.L tion for the Ministry of Transportation in the
Eastern Region
3 In the event the position of Occupational Health and Safety
Advisor is further revised, the grlevors wlll still retain their
right to be interviewed at the next competition, so long as the
position remains substantially comparable
4 This agreement continues in effect should the employees become
surplused, but not beyond the surplus period

5 The parties agree to make this Memorandum of Settlement an
order of the Board

As is evident, all parties, including the incumbent who appeared at
the hearing, signed the Memorandum of Settlement indicating their
acceptance of the terms and conditions therein.
Having regard to the agreement of the parties, the Memorandum of
settlement 1S hereby issued as an order of t~e Board
