Decision
[1] The Board is in receipt of a letter from the Association dated May 16, 2017
attaching letters dated November 1, 2016, March 21 and May 3, 2017 by which it first
requested the Employer produce certain documents and subsequently requested the
Employer to produce further documents and confirm, with respect to documents
produced, that the productions were in full compliance with its production requests. The
Association states that the Employer has not confirmed the documents produced were
in full compliance with its production requests.
[2] The Employer shall have until May 29, 2017 to:
I. Confirm to the Association that it has produced all the documents
requested, or
II. To the extent it objects to producing one or more of the documents,
file with the Board a list of all such documents, containing a brief
description of each such document and a brief statement of its
reason for objecting to producing the document.
[3] If the Employer objects to the production of one or more documents, the
issue shall be addressed at the May 31, 2017 hearing of this matter.
Dated at Toronto, Ontario this 24th day of May 2017.
Ian Anderson, Vice-Chair
