DECISION
Don Symons was offered a posItIon as a part-tIme employee performmg
summer relIef work on the condItIon that he be certIfied as an emergency
medIcal care attendant (EMCA) He began workmg In May of 1997 At the
tIme of hIre, no deadlIne was set for lum to obtaIn the EMCA certIficatIOn
Mr Symons took the exam m July but dId not pass HIS employment was
termInated on October 15 because he had not yet obtall1ed hIS EMCA
certIficatIOn He was certIfied In January of 1998, the next tlme the exam was
offered. In January of 1998, Mr Symons enrolled In a nurSll1g program at
Mohawk College
RegulatIOns under the Ambulance Act do not reqUIre a part-tIme
employee, workll1g not more than twenty-four hours per week, to have an
EMCA certIficate AccordIngly, the lIDIOn contends Mr Symons should have
been allowed to contInue workIng part-tIme The rehef sought IS
rem statement, WIthout loss of semonty, and compensatIOn for lost wages
The employer contends any compensatIOn should be reduced to take account
of the gnevor's return to school whIch rendered hIm unavailable for work
Based upon the formal submIssIOns of the partIes, and Informal
dISCUSSIOns WIth them, I Issue the follOWIng orders
1 The gnevor shall commence regular part-tIme employment on May
1, 1998 or as soon thereafter as he prOVIdes appropnate certIficatIOn
for all reqUIrements set by the Mnustry of Health and the base
hospItal

2 He shall be scheduled to work on the next schedule posted after
presentatIOn of the appropnate certIficatIon
3 The employer shall pay $1,500 00 to the local umon.
4 The gnevor shall be credIted WIth sIxteen hours semonty per week
for the penod from October 15 to December 31, 1997 He shall also
be credIted WIth semonty for all hours worked before October 15
