ArtIcle 31 4 (b) states as follows 314 (b) The Employer agrees to gIve consIderanon to the qual1flcanons and abihty of casuals for permanent full-nme vacanCIes at the entry level m theIr geographIc area, provIded that no permanent part-nme employees have apphed. Where qualIficaTIons and abihty are relaTIvely equal, semonty shall be the determImng factor Mr John DeLuca and Mr Robert GIOuntos were awarded the posInon In questIOn. Each was nonfied of these proceedings and of hIs nght to partICIpate m them, but neIther Mr DeLuca nor Mr GIOuntos attended the heanng. Umon Counsel requested at the outset of the heanng that the Employer produce the personnel files ofMr DeLuca and Mr GIOuntos. The Employer dId not oppose such request. Accordingly I order that the Employer produce to the Umon forthWith the personnel files of Mr John DeLuca and Mr Robert GIOuntos.
