HEARING November 20, 2001
DECISION
The parties referred these grievances regarding seniority calculations to
mediation/arbitration In accordance with Article 22 16 of the Collective Agreement.
At the outset of the hearing, the Parties agreed that I had the JUrisdiction to deal with
this matter and they requested that I Issue a without prejudice decIsion, with no reasons
Having carefully reviewed the eVidence and the submissions of the Parties, I find that
the Employer has applied Article 18 of the Collective Agreement In accordance with the
language and the JUrisprudence of the Grievance Settlement Board Further, should any
grlevor produce any further eVidence that the Employer has erred In the calculation of their
seniority within three (3) months, these grievances will remain active
I will remain seized of this matter
