INTERIM AWARD
These matters are scheduled to contmue on July lO and August 20 2l and 22, 2003 By letter
dated June 19 2003 the Mimstry has requested an adjournment of those days The reason for
the adjournment is that Mr Roy who had carnage of the matter for the Mimstry is leavmg the
Mimstry and will be unable to contmue to represent the Mimstry Havmg canvassed the
schedules of his colleagues and counsel at Management Board Secretanat, there is no one
available to contmue the matters on the days currently scheduled.
On June 23 2003 I convened a telephone conference call to hear the submisslOns of the parties
With respect to the request for an adjournment as the umon opposed the request.
Two issues underlie the gnevances The first is a converslOn issue The second is an allegatlOn
of harassment and discnmmatlOn. The converSlOn issue has a timely aspect to it as the
employer has made a commitment to convert four positlOns out of the Whitby Jail (where the
gnevor was workmg) by the end of July 2003 The harassment and discnmmatlOn issues anse
out of the gnevor's employment at Whitby and Millbrook and are largely focused on a specific
penod of time
Havmg heard the representatlOns of the parties I directed the employer to provide to umon
counsel and to the Board by no later than Tuesday, July 8, 2003 two thmgs, first, the
Mimstry's positlOn and mformatlOn regardmg the factual basis of the gnevor's claim regardmg
hours of convertible service and his semonty m relatlOn to other persons who might claim to be
eligible to be converted, mcludmg any penod where the gnevor was absent from work and is
claImmg recogmtlOn of those hours by virtue of the second gnevance Second, I also directed
the employer to provide the Board with the name of itS representative who will be takmg
carnage of these files
Upon receipt of that mformatlOn I will deal with the request for an adjournment.
