MEMORANDUM OF SE'lTLEMENT
BETWEEN
Cynthia Davey (THE CLAIMANT )
-and-
Ontario Public Service Employees Union (1HE UNION)
-and-
THE CROWN IN RIGHT OF ONTARIO AS REPRESENTED BY
(MINISTRY OF NATURAL RESOURCES )(THE EMPLOYER)
In the matter of aU oucscanding claims (WSIB claims, collective lsreement grievances, and WDHP-
related complaints) filed by the Claimant and me Union during the Claimant's employment with me
Province of Ontario, the afo~mentioned parties agl'ee to the foUowing terms as full and final settlement
of any and aU claims as (oUows:
1 The Employer apes EO rescind (he tenninalion letter dared May 26, 2003.
2. The Claimant agrees to provide tbe Employer with a resignation letter, effective May 26, 2003
Enclosed herewith and marked 15 Exhibit "A" is a copy oftbe said resignation letter.
3. The Employer win undertake to purF the personnel file of the Claimant of aU records ~latinl to the
Claimant's discipline and or tennination and further undertakes to provide the Claimant with a letter
confirming same.
4 The Employer agrees to provide tbe Claimant a reference Jetter. Enclosed herewith and madced as
Exhibit "8" is a copy of the said reference letter
S. The Employer wiD pay the Claimant eighteen (18) weeks wases at the straight time rate, less
statutory deductions.
6. The Employer wiD pay the Claimant one (1) week of wages at the straight time rate, less statutory
deductions, in lieu of vacation.

7 The Employer will pay the Claimant II days of wages at the straight time rale, less statutory
deductions, as compensation for the djsciplinary suspension without pay
8. The Employer will pay the Claimant ten thousand dollars ($10.000.00) as general damages, without
any statutory deductions. The aforementioned amount represents fuU payment of any and all
extended health benefits and expenditures.
9 The panics acknowledge that the Employer had offered the Claimant reemployment as a Stewardship
Coordinator and the Claimant bas declined such a reemployment offer Accordingly, the parties
apee thai me Employer has fulf1lled it's obligations pursuant to the Workplace Safety and Insurance
Act.
10. The Claimant acrees that there arc no wsm claims outstanding apinst the Employer as of the date
of execution of this memorandum of settlement.
11. The Claimane and the Union agree to withdraw all claims and grievances filed to dace ",jib the
Employer and the Grievance Settlement Board and provide the fmployer with written confirmation
of same. Enclosed herewith and marked as Exhibit "C' are copies of the said grievances.
12. The Claimant aclcnowleclges, with the advice oCher Union representative, that this memorandum of
settlement constitutes full and final settlement of an)' and all claims, complaints, grievances or
actions whatsoever that the Claimant has or may have agamst the Employer, its representatives,
employees and officials whether under a collective agreement, statute, .regulation, policy, contract or
at law as a result of or arising out of the Claimant's employment by me Employer or the tcnninatiOd
of that employment, iIlcluding but not limited to the Workplace Discrimination and Harassment
Prevention (WDHP) Policy, the Workplace Sqf~ry and Insul1l1IC. Act ,the Onklrio Labour Relations
Act, the Crow,. Employees ColleaiJle Bargaining Act, the Public Servict Act I the Employment
Standardr Act, or complaints unthr the Ombudsmtln Act. 1M Ottrario Human Rights Codt and any
ocher employment-related statute. Without limiting the generality of the foregoing, tile Claimant and
the Uoion hereby forever releases the Employer, its represent8lives, employees and officials from aU
such claims, complaints, grievances and civil actions.
13. The parties agree that this memorandum of settlement will be made an order of the Grievance
Settlement Board. -

14. The parties agree that thero is no admission of liability on the pan of either party and in fact any
liability perceived or otherwise IS expressly denied.
15. The Claimant agrees chill she bas been fully and fairly advised and ropresented by the Union, and has
made an infotmed decision in agreeing to the tenns of this memonndum of settlement.

Subject: letter of reference for Cynthia Davey
Cynthia Davey was appointed to regular staff as a Biologist with MNR in
Cochrane District in December 1993. She subsequenUy took the position as
Frontenac Stewardship Coordinator on May 25, 1995 She held this latter
position until May 26, 2003.
The purpose of the Frontenac Stewardship Coordinator position is to develop,
faster and facilitate effective and productive relationships with the fuR spectrum of
landownership and land interests, with the overafl intent of advancing natural
resource $ustainability and stewardship within Frontenac County
Cynthia left MNR's employ to pursue other career opportunities. The Ministry
takes this opportunity to wish her well in her future endeavours.
