Order
The Umon filed a polIcy gnevance whIch states that "the Employer IS In vIOlatIOn of the
collectIve agreement by the declaratIOn of the CPP (DIsabIlIty Benefit) COLA from L TIP
benefits" In thIS regard, the Umon IS requestIng the folloWIng InfOrmatIOn from the Employer
For members In receIpt of the LTIP benefits as of December 31 1997 the annual amount
(dollar and as a percentage) of "the cost of lIvIng adJustment" made on each of the
members' CPP base dollar rate of benefit, that was deducted by ManulIfe from theIr L TIP
benefit for each year and part year untIl the member was termInated from L TIP
For new LTIP recIpIents

The partIes agreed that I would Issue an order that the Employer IS to make reasonable efforts In
undertakIng to produce thIS InfOrmatIOn and provIde It to the Umon pnor to a meetIng to be held
on January 11 2005 subJect to further order of the Board. WhIle the Employer was prepared to
allow thIS order It expressly reserved the nght to argue that the InformatIOn IS not relevant, not
admIssIble and further that It IS not oblIged to produce the InformatIOn.
The partIes agreed that I would remaIn seIzed of any matter that mIght anse from thIS order
