DeCISIon
Mr Dom Aversa et al. gneved on December 16 2004 that the employer" IS In vIOlatIOn of
ArtIcle 8 2 1 of the collectIve agreement." The partIes referred thIS gnevance to
medIatIOn/arbItratIOn In accordance wIth ArtIcle 22 16 of the collectIve agreement.
At the outset of the heanng, the partIes agreed that I had the JunsdIctIOn to deal wIth thIS matter
and they asked that I Issue a decISIOn, wIthout wntten reasons
HavIng carefully consIdered the submIssIOns of the partIes as well as the Junsprudence of the
board, I hereby dIsmIss thIS group gnevance
