DECISION
[1] This arbitration relates to the termination of the employment of the Grievor, Paul
Paterson.
[2] On July 13, 2017 the Board heard submissions from the parties with respect to
production sought from Fido by the Union.
[3] It is hereby ordered that Fido shall provide a full account of the incoming and
outgoing calls between telephone numbers [xxxxxxx] (a Fido account in the
name of [xxxxxxx]) and [xxxxxxx] (a Bell Mobility account in the name of
[xxxxxxx]) for the period from November 16, 2014 through July 27, 2015.
[4] Fido will disclose and release the requested information to Daniel Fogel of Hicks
Morley Hamilton Stewart Storie LLP pursuant to this Order.
[5] Daniel Fogel will then produce the records to Dean Ardron of Ursel Phillips
Fellows Hopkinson LLP forthwith without redaction. If the records contain
personal information of [xxxxx] beyond that which was Ordered, counsel will not
disclose the documents to anyone until they have either reached agreement or
obtained a GSB order concerning their redaction.
[6] Upon receipt of the records, the Union will write to the Employer with the Union’s
position concerning Exhibit 7 and advise of any dispute concerning the
chronology or timing of the communications of July 26/27, 2015.
[7] My jurisdiction in this matter is retained.
